EDITORIALS SHACKLES NEEDED If a man whose legs were shackled called out for his arms to be shackled also most people would think he was crazy A normal healthy man would ask for the shackles to be taken away so that he might regain his freedom of action Some members of the Aurora town council give the appearance of a liking for their municipality to be restrained by legal shackles imposed by outoftown authorities In the year planning board brought to council a lengthy document known as the Zon ing ByLaw No one has said who put it together Some say it Others say it was which is keen art planning lgrd WftgMft it came from it is of practical use fur a small town such as Aurora In the Aurora town council took a bite of the zoning bylaw and finding it unpleasant put it aside It was revived in 1952 and in and aside oil both occasions as an indigestible meal The Aurora planning board has been pressing for its revival Some months ago Councillor Moffat told the council that the higherups were urging the planning board to get on with the zoning bylaw It came back to council on Monday night October 25 at a special meeting called for the purpose of further considering it There taxpayers who will be pleased TOWN SOLICITORS LETTER Property Owners Penalized Unless ByLaw Is Modified In a letter dated October 1952 the town solid- tor Mr Lome Lee analyzed and commented on the various complex clauses in the proposed Zoning By- Law which council considered at its special meeting on October 1954 The report provided by Mr Lee was in reply to a request made at a former meeting exist and are located in a zone not permuted under the bylaw may continue we must ascertain what the results would be should any of buildings burn down or be damaged In Ihls connection I have in mind the various store buildings on Yonge St Should one of stores burn down or bo destroyed another building to take its place must be constructed back feel from the lot line This might mean great financial loss to the owner of the parcel of land con cerned He might own a shal low and any new building would bo useless him and thus he would lose entirely the of his property He might only bo able to build or con struct a much smaller building than ho had formerly Once this bylaw has had three readings by the council and has been approved by tho Ontario municipal board no change or amendment can be made other than in a very minor way through a committee of adjustment except upon ap plication of the minister of the department of planning It will bo seen that any owner of property might be put to considerable ex pense trouble and delay In hav ing the permitted use of his pro perty changed to some other use Boundaries In regard to the boundaries separating one zone from an other the report states I main tain that these boundaries must be carefully defined Any own- of property should be able to ascertain in what zone his pro perty is located without the ex pense of a survey Any pros pective purchaser should be able to ascertain from the clerks of fice in what zone any parcel in which he is interested is located In many instances the boun daries are now outlined by street boundaries and this is very sat isfactory but in what would ap pear to be the majority of cases the boundaries are not defin ed Zone Zone gives us our greatest difficulty No buildings other than a onefamily dwell ing is permitted in this zone and then only in some parts of the zone provided that the conserva tion authority plans are not im peded and that the proposed sanitary facilities have the ap proval of the York County Health Unit holding jurisdiction Also minimum lot area is one acre There are many par cels in this zone which have an area less than one acre and many of which are built upon Those that are built upon will fall into the paragraph govern ing nonconforming uses Should any of the existing buildings burn down or be destroyed in any way the owners will be un able to rebuild and of course the present owners of such par cels which are not built upon could not construct any build ings I have pointed out to mem bers of council many so affected Practically ail parcels along the builtup portions along our creeks fall into cate gory What is to be expected of the owners of these parcels Are they to donate them to the town or are they to pay taxes continually in the
