council meetings There was a special on October 13 and this was mainly concerned with an exten sion on Edward St at a cost of some At this meeting also the mayor indicated his in tention of retiring from the mayoralty at the end of the year Another special meeting was held on Saturday Oct 16 to con- aider the situation arising from the flood on the previous even ing Chief among such consid erations were the need of the victims of the Holland Marsh deluge and the destruction caused to the arena floor Letter Of Slunk received too late for men tion last week a letter from Mr K secretary of Branch of the Aurora Cana dian Legion in which he ask ed us to express thanks to those who had given immediate assist ance In flood relief sponsored by the Legion flood relief cam paign One benefactor we did men tion last week namely Mr Roy Allan of service station on St who gave the whole of his profits for Saturday Oct to the fund This we find from Mr letter amounted to It was a fine gesture on the part of Mr Allan The Boy Scouts collected With Mr Allans dona tion the net cash received was Other Helpers The letter notes that Andy Anderson Legion member made and donated a sign of station CFRB gave the Legion efforts a boost on his ra dio program past president Bolsby and treasurer kept a record of receipts and Legionnaires Bill Cecil Kerr president J and secretary R worked as well as we could to keep up Roys reputation for friendly service Besides this assistance the let ter points out that Elmer loaned his mobile system for town advertising Tom Car ter of the club sent his man along to wash and his car truck besides paying for that privilege The proceeds of the effort are to be administered locally Sympathy For Family Mr Gordon Timbers has fig ured prominently in these recently in connection with the subdivision he has been striving to promote It is with very sincere regret that we must mention his name in another connection and that a very tragic one His 17yearold son was caught in equipment and suffered such serious injuries that he died in hospital The Timbers family wellknown and renowned in York county where several of them have ta ken important parts in civic re sponsibilities This newspaper joins with its sympathy along with relatives and friends of Mr and Mrs Gor don Timbers in their sad be reavement in the loss of their young son Did They Know It has been remarked that the robins which usually are to be seen here right up to the end of October and sometimes into early November disappeared in the early part of last month Through their early departure concerned he just isnt in the show at all Yet nearly voters elected him to council and we will be very much prised if that number isnt fit creased on December course it is quite true that Bill has never been a Ban ner cadet AbsentMinded Selections choose four names only from the council rollcall of nine members Inclusive of the mayor as representative of the task of handling a tough job seems strangely absentminded Of course it could be something else than absent Such professed picking at ran dom could be what is called iwiitics Wed have thought the mayor deserved a Banner hand for his EDITORIALS SHACKLES NEEDED If a man whose legs were shackled called out for his arms to be shackled also most people would think he was crazy A normal healthy man would ask for the shackles to be taken away so that he might regain his freedom of action Some members of the Aurora town council give the appearance of a liking for their municipality to be restrained by legal shackles imposed by outoftown authorities In the year planning board brought to council a lengthy document known as the Zon ing ByLaw No one has said who put it together Some say it Others say it was which is keen art planning lgrd WftgMft it came from it is of practical use fur a small town such as Aurora In the Aurora town council took a bite of the zoning bylaw and finding it unpleasant put it aside It was revived in 1952 and in and aside oil both occasions as an indigestible meal The Aurora planning board has been pressing for its revival Some months ago Councillor Moffat told the council that the higherups were urging the planning board to get on with the zoning bylaw It came back to council on Monday night October 25 at a special meeting called for the purpose of further considering it There was a point early in the proceed when it seemed that it would be thrown out But the mayor made a motion that it be considered and this was seconded by Councillor The ironical part of Mr Corbett- insistence that the zoning bylaw be further considered is that he took no turn in the dis cussion that followed The mayor did take part in the discussion One of his most Helling was to the effect that the map of Auroras Official Plan was not correct because it did not properly define the boundaries On that point he quoted from a letter written by the town solicitor RAILROADED THROUGH A legal document that is shown to be faulty will carry no weight before any tribunal Yet although the Official Plan map is not correct the special meet ing continued to discuss the bylaw that is intended to go with it Would not tho proper course have been to stop right there What is the use of building a house on a foundation which the architect tells you is not trust worthy But it might seem that the planning board and the higherup had to bo appeased Whether the map was right or wrong the zoning bylaw had to bo gone through Previous councils have only gotten as far as a few clauses in its complex and baffling setup But the special meeting swallowed tho whole contraption at a single meal which took three hours to complete fa It is true that there wore expressions of dissent and there and notations made on the bylaw draft by chairman Councillor Moffat will be sub mitted- to the planning board for its cogitations That imperial body may or may not assent tho suggested alterations Strong were made to the by- law itself as a whole by J Murray and Councillor William Davidson Both Mr Murray Mr Davidson suggested that the taxpayers of Aurora should be asked if they wanted such a bylaw for their town That question could have been answered by the voters on a form for the purpose at the forthcoming municipal elections But this demo cratic method of finding out the wishes of the people was not supported by other members of council A On October the town solicitor Mr Lome submitted a long letter to town council deal ing in detail with the proposed zoning bylaw and zon ing map Why was that letter not in evidence when the discussion took place on Monday night October The speed which The Thing was railroaded through suggested that somebody had to be pleased We doubt very much if it is the taxpayers who will be pleased TOWN SOLICITORS LETTER Property Owners Penalized Unless ByLaw Is Modified In a letter dated October 1952 the town solid- tor Mr Lome Lee analyzed and commented on the various complex clauses in the proposed Zoning By- Law which council considered at its special meeting on October 1954 The report provided by Mr Lee was in reply to a request made at a former meeting held to consider the proposed bylaw and attended by members of council and the planning board The following are extracts from that report which Aurora News Page considers should have been on the table at the special meet ing of October After some preliminary re marks the report says have given the provisions of the by law very careful consideration and towards this end have con sulted certain officials of the planning department of Ontario and have also looked at the by laws and zoning maps now in effect for the townshjps of North York and It is my decided opinion that in provide for a plan of the town Aurora as suggested by the zoning map not only must we aim at what would appear to be a satisfactory plan but we must also consider how such a plan affect the citizens of the town of Aurora The owners of pro perty to zoned off for certain permitted uses we must ascer tain whether or not these per- arc reasonable Possible Heavy Losses the bylaw provides any buildings which now exist and are located in a zone not permuted under the bylaw may continue we must ascertain what the results would be should any of buildings burn down or be damaged In Ihls connection I have in mind the various store buildings on Yonge St Should one of stores burn down or bo destroyed another building to take its place must be constructed back feel from the lot line This might mean great financial loss to the owner of the parcel of land con cerned He might own a shal low and any new building would bo useless him and thus he would lose entirely the of his property He might only bo able to build or con struct a much smaller building than ho had formerly Once this bylaw has had three readings by the council and has been approved by tho Ontario municipal board no change or amendment can be made other than in a very minor way through a committee of adjustment except upon ap plication of the minister of the department of planning It will bo seen that any owner of property might be put to considerable ex pense trouble and delay In hav ing the permitted use of his pro perty changed to some other use Boundaries In regard to the boundaries separating one zone from an other the report states I main tain that these boundaries must be carefully defined Any own- of property should be able to ascertain in what zone his pro perty is located without the ex pense of a survey Any pros pective purchaser should be able to ascertain from the clerks of fice in what zone any parcel in which he is interested is located In many instances the boun daries are now outlined by street boundaries and this is very sat isfactory but in what would ap pear to be the majority of cases the boundaries are not defin ed Zone Zone gives us our greatest difficulty No buildings other than a onefamily dwell ing is permitted in this zone and then only in some parts of the zone provided that the conserva tion authority plans are not im peded and that the proposed sanitary facilities have the ap proval of the York County Health Unit holding jurisdiction Also minimum lot area is one acre There are many par cels in this zone which have an area less than one acre and many of which are built upon Those that are built upon will fall into the paragraph govern ing nonconforming uses Should any of the existing buildings burn down or be destroyed in any way the owners will be un able to rebuild and of course the present owners of such par cels which are not built upon could not construct any build ings I have pointed out to mem bers of council many so affected Practically ail parcels along the builtup portions along our creeks fall into cate gory What is to be expected of the owners of these parcels Are they to donate them to the town or are they to pay taxes continually in the future or is the corporation to purchase parcels Many Other Difficulties The foregoing from the town solid tors report indi cate some of difficulties con cerned in proposed zoning bylaw But there ore many others outlined in report which lack of space compels us to omit MEMORIAL DAY SERVICES Cenotaph And United Church Services Sunday Nov 7 Arrangements for Memorial Day have been made for Sunday Nov when the parade will assemble at the Aurora and district High school at under the direction of parade marshal J Murray deputy- reeve of Aurora The parade will be led by the where a memorial service will Aurora and district High school band and will move off at ap proximately proceed ing along Dunning Ave to St and the cenotaph where a brief religious service will be held and wreaths will be
