jos- ephakuirgrieve a voter said that as she stood in line wait- in to vote she noticed a card with a suggested slate of offic ers on it on a counter behind the deputy returning officer the names on the card sha said were todd balsdon newman michell and law- son she testified that she called attention to the card and the next time she saw it it was torn in two and was in the hands of candidate fred hunt raised objection mrs frederick drew an ag ent for colonel stephenson at the altona polling place said she saw a man waiting to vote take a pink card with a sug gested slate of officers on it from his pocket she said she saw the name todd on the top of it she objected to the use of the card and asked the clerk to register an objection these cards were reportedly widely distributed before the election and were handed out at the claremont santa claus parade ii is ethel dand a scrutin eer for mr hunt in the conn- oil chambers in brougham re ported that the names of the councillors had not been re moved from the desks cleric does not appear mr brower introduced the case for the relator by stating that he was handicapped in that all records of the election had been destroyed on janu ary 19 he further stated that he had called the township clerk lloyd johnston to ap pear in the county court on monday for an examination but he had not appeared nor had he given any reason why he did not do so pie therefore asked that mr johnston who was in the court be called as the first witness although mr moore denied that he was there to represent mr johnston he objected to this on the grounds that mr johnston was not named on the notice of motion mr rower argued that mr johnston could be called as the official representative of the township which had been named mr greer at this time announced that he would also object to reeve todd being cal led since he had not been nam ed in the notice of motion dr roberts reasoned that the township of pickering a corporate body had been nam ed but could not obviously ap pear if the clerk had author ity to appoint mr moore to appear on behalf cf the town ship without the consent of the elected council he should be allowed to give evidence col stephenson claimed that as intervenor representing neither side in the issue he was able to call mr johnston judge pritchard ruled howev er that mr johnston could not be called at this time mr brower then asked that mr johnston be excluded from the court while col stephenson gave his evidence since he said this might give mr johnston an opportunity to improvise his evidence his honor ruled that mr john ston would not be excluded relator called gerald allman relator in the issue was called he be gan to tell of events at a polit ical meeting in whitevale prij or to the election lull following objection by mr greer this line of evidence was abandon ed he stated that following a meeting at the home of dep utyreeve dr kenneth rob erts on election night he had decided that he would lead an investigation and had delegat ed col stephenson to make this investigation col stephenson was then called the former intelligence officer admitted in his evidence that he had made a thorough study of the ontario municip al act following the election and it was also apparent from his evidence that he had heard about the evidence act because even the astute cross- examination by messrs greer and xewman failed to shake him and in fact he appeared to enjoy the verbal tugofwar col stephenson said that on thursday preceding the elec tion he had happened into the office of the pickering news where the ballots for the wat er line question were being orepared he said that he not ed they were not beins word ed in the manner prescribed by the municipal act and he hal relayed this information to township clerk lohnston in brougham on this visit he said he had told the cierk that he had heard that voting cards might be used again and ask ed him if r he would advise reeve todd of this the clerk he told the court had stated that he would communicate this matter to mr todd on the sundav preceding the election he said he had again visited the clerks office officer to leave the polling place for part of the day anil his wife beine allowed to take over and allowing certain sen ior citizens to be present at the counting of the ballots in view of knowledge i had of previous election said col stephenson replied that this one should be run according lto the rules election day at noon on election day said col stephenson major emd smith had brought to him a small voting card which was then introduced as an exhibit on receiving this said he he had called the police and ask ed them to visit the place from whence this card was re puted to have come and verify that such cards were being picked up they were instruc ted he said to go to the store of js balsdon brother of the unsuccessful candidate for dei putvreeve that evening he said he had visited another polling place anil had observ ed three persons throwing something awav or the ground his curiosity had been arous ed he said and he had investi gated and had recovered an other voting card which was also made an exhibit during the day he contin ued lie had occasion to visit the polling station at fairport beach where he said he had been tirged by a person in the polling place to purchase three tickets on a doll which was to be rallied 1 bought three said col stephenson and did not win the doll at that same polling station ho said he had noted persons marking ballots in a room leading from the room where the ofiicialsof the station were seated it was possible he claimed for persons other than voters to see how the ballots were mar ked he added at this point that it was neither the deputy returning officer nor the pol ling clerk who had sold him the tickets on the doll ballot counting after the polls had closed said col stephenson he had visited the dunbarton polling place to watch ballots being counted there he said he found the ballot box open sit ting on the floor at the feet of the deputy ireturning officer the dro he said was at that moment holding in his
