perplexing problem on its hands concerning the upkeep of the sixth concession road originally this road was designated a county road and the county built a macadam top on it later a council was influenced to assume the road again as township property from unionville to the north townline in lieu of our taking the road back at that time the 8th concession from markham to ring- wood was assumed by the county thus we still had the same milege of county and township roads now we find the macadam in bad shape on the 6th and the township council has no machinery to repair it with it was a mistake we think to ever take it back from the county and an effort must be made to have the county assume it again increased motor traffic on the 8th warrants the use of the 6th we contend thomas sitting of division court held in stouffville on monday the chief case being that of john cawthorne of markham township vs thomas phillips of brougham and elmer jones vs phillips the cases being tried jointly or from he same evidence the dispute arov over a motor crash last september on the night of tho street dance in stouffville when percy phillips son of the defendant drove his car into the parked bus belonging to caw thorne and in which mr jones daughter was a passenger the judge held that phillips was in the wrong and assessed him 40 on the cawthorne claim and 120 on the jones claim with costs of around 60 f l button kc acted for the plaintiffs cawthorne and jones while phillips and his son were de fended by mr anderson of the wen sinclair law firm in oshawa following the accident phillips driver of the car paid a 10 fine for reckless driving on a charge laid by constable walker of markham on the night in question john cawthorne so the evidence showed was seeing iiis girl home leav ing stouffville around midnight and driving to gormley with a passenger after which he proceeded to dickson hill with miss dora jones they stopped in front of her fathers home elmer jones and after parking there about ten minutes percy phillips crashed into them dumping the parked car into the ditch from the impact badly smash ed and severely injuring miss jones who was thrown out both cars were headed south and both were or ancient vintage in fact cawthorne purchased his chariot for 35 al though he was allowed more than the purchase price by the judge a fact which bought a mild protest from the defending lawyer many witnesses were called in an effort to prove the parked car had no tail light showing but his honor accepted the evidence of don wilson garageman of ringwood that following the crash he placed a good bulb in the socket of caw- thornes car and it lighted all right all the evidence went to show that the parked car was well off the roadway miss jones and her mother mrs elmer jones testified to establish the amount claimed for damage to the daughters person and to her clothing which was torn and spotted with blood from a wound in her head other witnesses called by mr button were ernest staley alf staley harold underwood don wilson dr h b freel and constable jas walker on the other hand the defense brought forward no less than eight witnesses besides the two phillips men edw wurm and a truck load of men who passed the car parked in front of jones residence all de clared they never saw a tail light at all but most of them admitted they were not keeping a sharp look out wurm passing the parked car made the comment that someone would strike that car percy phillips driver of the accused car said he had not been drinking but admitted taking just one glass before he left home to attend the dance he told mr button on being crossexamined that he might have been watching the oil gauge threeparts of tho time and made this damaging state ment twice jones on behalf of his daughter for full claim of 120 reducing the claim of caw thorne from 550 to 40 he pointed out that the defendants own evi dence was that his lights showed 35 feet ahead but the act requires tliem j to show 60 feet cawthorne would have been safer to pull in on the entrance to jones property but phillips had a chance to pass and with reasonableness should have done so observed his honor a counterclaim enter by phillips was dismissed without costs j g lunau was given judgment against herbert jackson for full amount claimed of 45 the amount of a note held against defendant ben harrington sued j s baird for 4350 alleged due on purchase of a field of corn and which was garnisheed by a dairy company judgment for plaintiff for 4205 harrington held an auction sale when giving up farming last fall on the kennedy road no public inter est in this case up in the township of manvers adjacent to lindsay they had a sensational election on monday first he returning officer failed to pro- ide enough ballots in one division where the voters turned out 9s per cent of the vote and ballots had to be rushed from another poll over snowbound roads from janetville to bethany the few who toted on the surplus ballots could be detected as the janetville poll number on the ballot was different from bethany and the vote was not altogether a secret ballot it may be taken to tho judge for settlement the hotness of the contest in manvers is noteworthy as it was a year ago ernest beer candidate for the reeveship defeated his opponent f s gray by one vote 595 to 594 last year
