thereafter until further notice geo b padget reeve markham township passed at unionville s r december 4 1933 tho appeal case brought by the township of whitchurch against tho executors of the cj vanostrand estate from judgment handed out by his houor judge widdifield last fall was heard beforo chief justkes latchford riddell and fisher in appeal court at osgoodo hall on thursday and tho judg ment sustained the appeal by the township was on a stated caso asking whether tho lands while occupied by tho toronto mens hostel as a farm under a lease from the mortgagees in possession aro entitled to exemp tion from taxation under ss 9 sec 4 of tho assessment act j ii naughton appeared for the appeai- ant township and w s mont gomery kc for respondent the vanostrand farm of 335 acres at vandorf on which the well known white house is located had been leased to the tor onto hostel a charitable institu tion sending men from the city to the farm to be kept the rental is s00 annually the hostel is main tained by public benefactors and they sought beforo the court of appeal last summer to have the farm exempted from taxation be cause they are a charitable organ ization their appeal being dis allowed it was carried before county judge widdifield under the section of tho assessment act re ferred to above and his honor exempted the whole property from taxation realizin ithat this would work a hardship on the school section at vandorf and was otherwise unfair to the town ship the decision was appealed by the township the farm had paid in taxes 225 annually including 22 school tax the section ot the assessment act under which the case rested is said to have been drafted at a time when no thought was given to such charitable organizations ex tending their interests to rural sections and because of this an effort will shortly be made by the township council of whitchurch to have the assessment act so amended that at least school taxes cannot bo exempt for any purpose whatever as a matter of fact the township council have already- moved to bring the matter to the attention of the legislature which meets in february thus by oppos ing an unfair section of the assess ment act is likely to lead to a change in the law that will ultimate ly savo the school section involved from a loss of taxation from this largo property the section of the municipal act which the council claim is unfair reads as follows in reference to exemption every industrial farm house of industry house of refuge orphan asylum and every boys and girls or infants home or other charitablo institution conducted on philanthropic principles and not for the purpose of profit and gain and every house belonging to a company for tho reformation of offenders and the land belonging to or connected with tho
