elizabeth forester mrs forester was the daughter o tho late george and catherine wright and was born in whit church in 1s46 her parents were very well known in the primitive methodist life of this was david dowson plaintiffs alleged negligence on tho part of the truck owner in leaving his truck on the highway from early in the morning until the hour of the accident both the mc millan brothers were injured after the crash and their car was dam aged has counterclaim harding the owner of the truck is also seeking to recover 500 damages to his truck and contents alleging that at the time of the accident the truck was protected wih lights that a man was swing ing a lantern on the road to warn approach traffic and that the driver for mcmillans was negligent in not observing the warnings and travel ing at too great a speed to permit him to stop judge thompson adjourned the case until thursday morning when he will hear the arguments of coun sel and give his decision the court during the day heard several defense witnesses including experts downson the driver of the mc millan car gave evidence which was corroborated to the effect that on the night of the accident the road was slippery that he was not driv ing more than 25 or 30 miles an hour and that the outline of tho load of hay on the track was diffi cult to see until the car was al most upon it evidence was given to show that the truck which broke down early in the morning was parked on the highway all day and it was contended that this consti tuted a menace to traffic much of the evidence heard on monday was of
