but who has been in the county gaol at whitby with the exception of some vmonths at christie street hospital since that time owing to appeal proceedings has been given his liberty on the order of the crown authorities in toronto the reason for this deci sion it is learned is that the crown has been unable to secure any new evidence in the case necessary for a new trial slee it will be remembered was convicted of setting fire to the store of j j bartlett a rival merchant in the village of zephyr in sept 1924 who swore that his loss was 6000 the crowns principal wit ness at that time was a man named wm hillis an aged man with a long criminal record now serving a term for robbery in that part of the county who swore that in company with a man named charles land another convict also serving a term in kingston he engaged slee to set fire to the store at zephyr for the sum of 100 it was alleged by these men that they visited slee in the village in june three months previous to the fire to look the ground over preparatory to setting fire to the bartlett place there was a lot of evidence sub mitted in defense but the jury re turned a verdict of guilty and mr justice riddell sentenced slee to 12 years although the judgesuggest ed that the jury recommend mercy no such recommendation was made a fact that was commented upon by tji t a i advertisers holding display space must have
