is some talk of a picnic here in the near future the horses becoming frightened by the steam blowing off when passing the engine of the tongue of the wagon dropping to the ground and graham jumping off the wagon when he lost control of the horses and of the team crashing into the cutting- box and smashing it his honor reserved judgment to determine whether the arbitrators were properly selected and convened and if not to determine if there had been negligence he rendered decision on monday briefly as follows i think it clear the plaintiff cannot recover the al leged award there are many fatal objections i need mention only one the award was made under a verbal submission which contains no conditions whatever the judge cited several precedents and set aside the award on the merits the plaintiff must fail i cannot find any act of the defendant which caused the negligence i think when the horses bolted he did all that he could do all he could be expected to do under the circumstances the action will be dismissed but as the defendant did refer his claim to the arbitrament of the parties he refus ed to aibide by their decision it will be without costs the grand championship prize
