of ontario has a mem bership of more than 120 pit and quarry operators throughout the province the association works closely with members in land rehabilitation and sequential use of aggregate sites sept 9 through her lawyer don kimura miss blaedow attempted to appeal the seizure but the appeal was not dealt with as it was filed too late mr kimura then went to the ontario supreme court and obtained a restraining order for bidding the society to dispose of any more of the animals mr kimura made a second appearance before the supreme court and was successful in obtaining a mandamus ordering the animal care review board chaired by dr alan secord to hear the appeal the appeal date was set for last thursday but was postponed one day at the request of mr hughes who had taken over handling the case from chief inspector don hepworth mr hughes request for an adjournment was denied and inspector parry gave his evidence photographs taken by society public relation man nick ibscher showing the condition of the dogs and barn were accepted as evidence dr secord concluded from the photographs that some of those animals look in excellent condition mr hughes said the condition of the dogs is not the basis on which the society acted adding the animals had been taken because of the accommodations provided evidence was given that there was no sign of food or water garbage was strewn about the barn and there was dog manure all about the barn at one point mr hughes said the name of the organization was the society for prevention of cruelty to animals and it was their duty to
