need fespbrnk of the 5th april at which time there was a lengthy discussion regarding the proposed reloca tion of the burton wood-work- ins plant on the brock road and which removal is opposed by two residents on the brock road including our selves whereas i am not prone tn writing letters to the editor i am doing so now out of deep concern for what has transpired in this case partly from a per sonal point of view but mainly because of the situation that ap pears to exist in the municipal ity with regard to their bylaws pickering twp passed a zon ing bylaw after considerable study discussion and expense to the ratepayers of this munici pality this document has been read a third time and has never been forwarded to the ontario municipal board for approval notwithstanding this fact the municipality has been enforcing this bylaw for the last eigh teen months or two years as if it were in force and effective one of the main contents of this bylaw which has been en forced is the 2000 sq ft re- teaching areas and staff show great gain over 1952 an interesting paper distri buted to trustees attending the 10th convention of the york county elementary scitool trustees association hed wed nesday at huron heights school gave statistics on the growth of teaching areas for 1 the removal of this striic- the elementary schools in the april sth 1965 ed to certain citizens must un der a democratic form of gov ernment apply to all citizens in my submssion i have de tailed the reasons why these ob- iections have been made and received from planning board and council were that they had made a decision and they saw no reason to vary from it not withstanding the facts that ture conflicts with th zon ing bylaw passed by the council and this bylaw be comes rectroactive tnon the date of its approval by the omb and the fact that this bylaw is being enforced in other instances 2 the structure if relocated is in conflict with the build ing bylaw of this municipal ity i find it of considerable con cern that apparently upright citizens who make up the mem bers of the planning board and council of pickering township are prepared to ac indiscrim inately in such matters and to completely ignore bylaws pas sed by themselves and also as to the statements made at the council meeting which were taken by your member f siaff hut which were not quoted in the press example no refer ence to my statements regard- quirement for a house in cer- 1 ing letters from the omb and tain areas county engineer the solicitor the purpose of this zoning for mr burton disregarded my bylaw is to afford protection to j complete submission by making all properly owners in the twp the statement that it was based and so that any owner or pro spective owner without discrim ination fear or favour may avail himself of ihe land use and development requirements of a municipality by law the right of discretion by a council or civil servant is prohibited in a zoning bylaw the same purpose is intended by the passing of the building bylaw in a municipality which provides for regulations respect ing construction of buildings and must be applicable to all in a municipality my submission to the planning board and council a copy of which 1 am attaching hereto for your infor mation was not submitted face tiously nor with lack of knowl edge upon the subject of which i was writing i was aware when i first made my submis sion to the planning board that the pickering township zoning bylaw affecting these lands had not been approved by the ontario municipal board i did not know at that lime that it had not been submitted for ap proval however i ws aware that the townsliii ivas enforc ing the contents of this docu ment and i felt it only reason able that what was being appli- on the zoning bylaw covering these lands and that this by-law- was not effective becajso the omb had no yet approved it i find this to be a most regret table statementin a public ses sion and i note that no refer ence was made to this in your press coverage this being the case gentle men the municipality has no county the chart cited 1932 figures and then gave comparative 1953 and 1961 figures teaching areas almost quadrupled be tween 1952 and 1965 with 2st then and ss3 last year largest gain showed in the separate school areas with only 10 in 1952 and 115 in 1961 only one urban area wood- bridge showed a decrease with 17 in 1963 and 15 last year greatest increase was in aurora with only 16 in 1963 and 65 in 1961 newmarket figures show ed 1952 23 1963 50 and 1961 54 north cwillimbury showed the greatest gain in the town ship statistics with 13 areas in 1952 and 13 in the past two years other comparative fig ures gave east gwiltimhury 22 13 king 31 76 vaughan 55 106 georgina 7 12 markham 31 9 and whitchurch 26 50 comparison of teaching staffs from the years 1953 until 1961 also showed radical changes only secondary school figures were given in the schedule but aurora high school had 17 teachers in 1953 and 3s last year sutton district high school employed eight in 1953 and last year ihe total was 36 stouff- ville figures were also eight ill 1953 and 23 n 1961 totals for the to its conflict with ihe build ing bylaw reeve laycow on two occasions and one her member of council emphatical ly stated that ihe council had at no time authorised the building permit to be issued and that they agreed that this was the jurisdiction of the building in spector who has i submit no authority to grant a concession but must abide by councils by law mr burtons solicitor made no
