Th« cffences were that they first, were in possession of high grade gold ore, and secondly, that they attempted the theft of gold ore from the Hollinger Mine. While searching, Constable Munro picked .up King‘s lunch bucket and opened it. Inside he found a bundle wrapped in waxed paper. In the parâ€" cel was high grade gold ore. "I didn‘t know it was there. What will I get for it," King immediately said. testified the police officer. _ He tcck both men to the police station. There, after he warned the men, King said that he worked on the 2,300 foot level at the Mollinger Mine. He had worked there for nearly four years. He told Sergeant Melville that he ate his lunch underground and put his buckst in a hole in the wall 20 feet away from ‘where he was working clearing a mill hole. The only men who were with him in the working place were his partner and the shift boss, Bill Spencer, who came through about 5 p.m. Buck was cleared of both charges after preliminary hearings and King was remanded for trial before a judge and jury on the charge of being in possession. After he was committed for trial, the secondary charge of theft against him was withdrawn. At that point Magistrate Atkinson dismissed the charge against Buck and committed King for Itrial before a judge and jury. Crown Attorney Caldbick said that he wished to withdraw the charge of theft against the committed man, ‘King. The charge of theift against Buck was proceeded with. The charge of alleged that Buck made an attemp$ to steal gold ore from the mine between December 5 and Deâ€" cember 25.. There was only one witness, George Suzack. Suzack said that he did not work with Buck but was on the same level. One day between December 20 and December 23 Buck came to him in his working place. (He may have had reaâ€" son to leave his own working area as he was gathering old tools at the time. "He made me a proposition," Suzack said. "He said he would supply me with high grade and if I would take it out of the mine and off the property he would spliys with me fifty per cent. I told him I wouldn‘t have anything to do with it.
