Councillor Bill Roberts expressed. the opinion that the Council is receiving undue criticism with regard to the apâ€" pointment of a cemetery board. "This was turned over to the Board of Health some time ago," said Mr. Roberts. Mayor Bartlemanâ€"‘"This matter is entirely up to the health officer and so far he hasn‘t taken any action. Gold Receiving Charge Against Lamothe Fails The prosecution of Charlie Lamothe, of South Porcupine, on a charge of reâ€" ceiving $41,000 in gold precipitates, stolen from the refinery of Dome Mines on the morning of June 8, came to an abrupt conclusion here Tuesday night when Alphonse Labrecque, star witness for the crown repudiated the greater portion of a statement given to Provinâ€" cial police some time ago. Crown Atâ€" torney Caldbick admitted that the enâ€" tire case depended on Labrecque‘s eviâ€" dence and agreed with Magistrate Atkinson that a committal for trial was unwarranted. Lamothe was represented by Dean Kester, K.C., who at the outset pleaded not guilty on behalf of his client and elected to be tried by a higher court. Labrecque was the only witness called by the Crown. "‘The whole case depended on Laâ€" brecque‘s evidence and there is no point in calling any of the other witnesses," said Crown Attorney Caldbick. After three rounds of drinks, he claimed that one of them suzgested that they get some whisky. He told them that he didn‘t have a permit but said they could drink some wine in his room. One of the men, he testiâ€" fied, gave him $2 to buy wine and they had all gone to his room. Later more drinks were suggested and one of the trio was said to have pushed some bills toward the accused and told him to get three bottles of gin. It was this money that was found on him when he was arrested, Huckabone told the maâ€" gistrate. Asked by the Crown Attorney to exâ€" plain why he had had thirteen men examined by Dr. Stahl, he claimed that Burton Tanner, of Hennessey Henâ€" nessey, of Haileybury, had asked him to get some men and he had sent them to the doctor to be examined. ‘"There is no examination necessary for bushâ€" work, and in any event bush work isn‘t surface work," remarked Mr. Caldâ€" bick. Huckabone denied that he told his accusers that he could get them work in the mins. Asked what he did for a living, he said that he writes letters and gives information. "Lots of men come to me every day," he added. Magistrate Atkinson refused to acâ€" cept the plea of Huckabone that he had been given the marked money to buy gin and could see no reason why the testimony of the three witnesses couldn‘t be believed. "You admit that men are to yclu every day and the evidence shows it," said the bench.
