Saturday, June 21st, having been iound guilty at the spring assize at Cochrane of causing the death of License Inspeéecâ€" tor Harry Constable, at Cochrane, on October 15th, 1926, by shooting him, for the purpose of entering an appeal against the sentence. The money has been placed in the hands of M. Cr. Hunt, barrister, of Kirkland Lake, who has been retained in connection with the case by the subscribers. Additional subscriptions are reported to be coming in daily. Notice of the appeal has been already entered at Osgoode Hall, Toâ€" ronto, by Harry Fine, Ansonville lawâ€" ver, who defended Ivanchuk at the asâ€" sizes and Arthur G. Slaght, K.C., of Toronto, has been retained as counsel. The appeal will, it is expected, come before the Divisional Court for hearing within the next two weeks. The grounds for appeal are stated to inâ€" clude new evidence, not available at the trial. This evidence, it is claimed, will show that the condemned man could not possibly have committed the murder as he was with another person at the time of the crime and his moveâ€" ments can be accounted for. It is also submitted that Ivanchuk is rot guilty according to the evidence and that the judge, Mr. Justice Raney, in his sumâ€" ming up erred when he failed to stress the evidence for the defence as strongâ€" ly as he did that for the Crown. Also that the verdict of the jury is contrary to the weight of the evidence."
