The conviction was quashed and the Ontario Court of Appeal judgment upholding it was over- ruled. Lemieux's arrest came.as Ot- tawa city police were trying to track down a "hooded gang." The Supreme Court noted that after an informant named R. D. Bard talked to police Nov. 16, 1963, they looked for a house where a break-in could be staged. Bard picked a house belong- ing to Benjamin Achbar, who gave police the key and al- lowed them to stake out the premises.'
