NO "GET - RICH PLAN" By STUART LAKE OTTAWA (CP) Ontario lawyers were warned Saturday not to abuse the province's new legal aid program expected to come into force within a few months. Rather than viewing it as a plan to make them "rich or fat,' they should look upon it as "a challenge to ensure the public gets full value for its money." Brendan O'Brien of Toronto, treasurer of the Ontario Law Society, issued the warning at the closing session of the two- day mid-winter meeting of the Ontario branch of the Canadian Bar Association. Under the plan, Ontario resi- dents can get legal help for both criminal and civil actions whether they can afford it or part in the plan place their names on regional lists and would-be clients can pick the lawyer they want. CAN REJECT CLIENT The freedom of choice applies also to the lawyer. He is free to accept or reject clients, the same as in normal practice. Changes will be based on a schedule of fees prepared by the law society and now under study by the provincial cabinet. A. Arthur Martin of Toronto, chairman of the law committee working on the plan, said the fees are based on what a lawyer normally would charge a client of modest means. Legal-aid lawyers will submit bills claiming 75 per cent of the agreed charges. But they were warned the bills will be scanned for such abuses as unduly de- SQUARE -DEAL FOR PUBLIC ASKED THE OSHAWA TIMES, 9 Monday, February 6, 1967 Lawyers Warned About Legal Aid taking frivolous cases to court, or electing trial by a higher court than necessary. The gathering approved in principle a_ resolution asking that criminal records be erased after an unspecified time inter- val. Joseph Pomerant of Toronto said such an amendment to the Criminal Code would allow ex- convicts to live normal lives after serving their jail terms. 'The detectives account was at variance with the company ver- sion on why the auto giant in- vestigated Nader. GM had said at Senate subcommittee hear- ings last year that the purpose was to see whether Nader was involved in litigation which con- tended Corvairs were unsafely designed. Vincent Gillen, a. former FBI agent, said in a deposition that he had been hired by Richard F. Danner, a Washington Nader. The auto critic, author of the book Unsafe at Any Speed, is suing GM for $26,000,- 000 in damages, alleging inva- sion of privacy. Gillen also is a defendant in the pending suit. Roche, who apologized last year to Nader for the investiga- tion, saying, "1 am shocked and outraged by some of the inci- dents," stated Sunday in Detroit he had not seen the detective's deposition. He added: "Whatever I had to say be- fore the Senate subcommittee was the truth." REPORT SAID ALTERED Gillen said the first page of his report given to the subcom- mittee was changed "because it did not coincide with General Motors' d purpose of lawyer representing the auto firm, "'to get anything they (General Motors) can on Ralph Nader." "The true purposes of the in- vestigation," Gillen said, were "to discredit (Nader) and shut him up." RECORDED TALK He said GM, including its President James M. Roche, was lanning to disclaim responsi- ility before the Senate subcom- mittee for the type of investi- gation, when he informed GM statements made to him by Danner in reference to Nader. Subsequently, he said , the firm. deleted. portions of state- ments indicating GM was not responsible for the nature of Gillen's inquiry. Gillen's statements were made in an affidavit of reply filed in New York state Su- preme Court Friday to ques- investigating Ralph Nader's connection with the Corvair liti- gation." Gillen's statement said GM instructed him to check on anti-| semitism in Nader's Lebanese family background and sug- gested that he look into a sniff- ing habit of Nader's for possible "dope addiction or the use of narcotics." In Gillen's entire investiga- tion, which "encompassed the interviewing of more than 30 persons and the checking of Nader's records back to his childhood, not a single state- ment was made or found which indicated any anti-semitism" on his part, he said. The only complaint made to him by Danner or General Mot- ors about the investigation, Gillen said, was to the effect that it had not gone far enough in attempting to discredit Nader. Nader's lawyer had filed a re- tions submitted by counsel for quest for admissions from {presidential election for a four- year term. CLAIMS FOUL Even before the polls closed, Aguero said his partisans had reported "almost 1,000 irregu- larities of all kinds." Aguero, an eye specialist, claimed his party's officials were refused entry to the polls.
