Finlayson, counsel for Ciglen, argued that both men filed income tax returns for 1956 and were assessed as provided in the Income Tax Act. He said they were not as- sessed for profits from the sale of Kroy and Great Sweet Grass. The Crown must establish, Mr. Finlayson said, that Ciglen got in touch with others and that each individual conspirator agreed with Ciglen and Black to commit the offence with which the men are charged. Ciglen and Black were ar- rested in May, 1961, after an RCMP investigation that lasted more than three years. were committed for trial after a Agee preliminary hearing.
