It took the jury 40 minutes to agree that Howard Navin, 704 Byron street south, died acci- dentally when he was struck by a speeding CNR passenger train beside the Whitby CNR station, on Jan. 28 at 12.50 a.m. The jury attributed his death to "carelessness on the part of the ed" deceased". Dr. J. 0. Ruddy, coroner, said that Navin "'suffered a number of dismembering injuries, any one of which could have caused death". Ex-OPP Constable Clifford Pegg told the jury that while patrolling Highway 401 at 12.45 am, Jan. 28 he had observed Navin on the centre boulevard, walking towards the tracks where the accident occurred several minutes later. He said said it was vious" blame to attach to anyone" for Navin's death. ccidental explained that customers com- plained Navin was unable to carry out some duties, such as carrying parcels of groceries for passengers. He said that at the time of his dismissal Navin had - indi- cated that another job was open to him. Engineer Edward Fisher said the train had been travelling at about 80 mph when it struck Navin. He said Navin had pro- ceeded from the station plat- form onto the. eastbound tracks at a "'leisurely walk" and had made no attempt to avoid col- lision with the train. Investigating officer Constable Don Williams, Whitby PD, told the jury that Navin's body was found about 141 feet east of the station on the westbound track. "At least as it apparently now stands," one member re- marked. Chamber president John Pan- tony, referring to the $4000 per year subsidy granted to William Sherrin of Ajax, said: "I am pleased they have finally con- cluded their obligation to the people they represent. "We pointed out to Council that an ambulance could not exist in Whitby effectively with- out subsidy. "We pointed out that, after the principle of subsidization had been established, some method of implementing sub- sidy was necessary in the best interests of the people. "We pointed out that some form of contractual relationship Was necessary. "We urged that the ambu- lance be located in the Town of Whitby. "We urged that it be oper- ated by competent people. "All of these objectives ap- pear to have been covered in the system arranged by the town."
