WHITBY And DISTRICT Crown Halts Inquest Whitby bureau Office 111 Dundas St. West Manager: John Gault AJAX (Staff' -- A Coroner's inquest into the death of Gor- don Douglas Gilchrist who was killed in an auto accident in Ajax, Nov. 29, was adjourned last night due to the absence of two witnesses and the surprise introduction of a third. Gilchrist, 59, of 20 Birch cres- cent, Ajax, died early in the morning of Nov.. 30, after the car he was driving was in- volved in a collision at Har- wood avenue and Birch crescent at 10.40 the previous night. Coroner R. S. Irwin of Osh- awa conducted the inquest with Crown Attorney Bruce' Affleck guiding the questions for the five-man Coroner's Jury. Constable Eric Place of the Ajax Police Department told the jury he was parked in the police cruiser on the lot at Harwood and King's crescent. The officer stated he saw two cars proceeding north,on Har- wood avenue side by side at a "high rate of speed'. "I gave chase to the vehicles but was momentarily slowed by a red light and lost sight of them. "After coming through the light I saw two cars that had been in a collision on the north |west side of Harwood avenue near Birch crescent, ed on Harwood and was chasing. "Gilchrist was pinned between two seats and appeared to be regaining consciousness. The other driver was runn'ng across Harwood avenue with blood on his face. WAS PASSING Be The officer stated that, at the time of the accident, a light rain was falling and the roads were wet and slippery. Sgt. William Shaw of the Ajax Police Department said the car proceeding north on Harwood avenue was driven by Lucien Emard, 23, of 336 Arthur street, Oshawa. The car driven by Gilchrist was proceeding west on Birch crescent when, while making a turn onto Harwood, it was struck by Emard, the inquiry learned. Sgt. Shaw disclosed that Emard was in the process of passing a vehicle in the left lane. The Gilchrist car received ex- tensive damage to the left side and the other vehicle was badly damaged on the front end, Con- stable Place concluded. Pathologist, Dr. R. Clark said the cause of death was a rup- tured aorta (artery from heart) and that Gilchrist had suffered jextensive injuries including a rae 2 Witnesses Absent A blood sample taken from the dead man revealed no trace of alcohol Mr. Affleck rcvealed. Emard gave his evidence wth the assistance of an interpreter. He was driving north on Har- wood at 30 miles per hour, he said, following a car driven by Robert Wry, 11 Glynn avenue, Ajax. 5 "Wry was in front of me. I don't know why he slowed down but when he did I passed him. "I didn't see the other car coming out of the _ intersec- tion until he was only 75 feet away. I hit the brakes. The inquiry was halted when Mr. Affleck said he was "'just informed that one of the law- yers involved in the case had a surprise witness and that two other witnesses were in Quebec and should have been brought to give testimony". The Crown was granted an adjournment until Feb. 11 when) pi witnesses would be avail- able. Count Against Hospital Is Dismissed | Crown Suggests! Deportation As Youth's Penalty "All are welcome in_ this country," observed Magis- trate Harry Jermyn here yes- terday, "but they must obey our laws. This was prompted by Crown Attorney Bruce Affleck's recommendation that Frank Mottola, 72 Greensides avenue, Toronto, be deported back to his native Italy. The youth was convicted for breaking and entering Palm Billiards, 130 Dundas _ street west, Whitby, and the theft of a transistor radio, two watches, and a carton of American cigarets. Sgt. Gerry Robinson of Whit- by PD described the reasons that Mottola had given for his actions: "He told me We had issued a worthless cheque earlier in the day (Jan. 18) and had broken in at night to retrieve it. for "When he could not find the cheque, he claimed, he stole the articles." All of the goods were re- jtrieved by police with the exception of about $2.70 worth of cigarets. The total value was approximated at $71 by a Robinson and Mr. Affleck. r.
