Mr. Affleck is the Crown) Attorney for Ontario County. Mr. Baynoe was defending the! two accused on charges of; attempting to deceive the pub-) lic, and for peddling without al licence. Magistrate Harry Jermyn re- served j.dgment. on the matter of attempt to deceive until next Tuesday's session of Magis- trate's Court. | Timpano, of Etobicoke, and Schwartz from Toronto, were charged on Aug. 8 by Set. Dick Bodley of the Pickering| Township police, the court learned. "They admitted that they had been attempting to sell merchandise in the township, and they admitted further that they had no licence." The crown introduced six wit- nesses. Two of them, Charles) Smith and Lee Morgan 'testi- fied that the two accused had attempted to sell them articles of jewellery, watches, and a} razor. | The remaining four were) classed as "expert witnesses." Mr. Smith _ testified | that Simpson and Schwartz had vis-| ited his service station each week for a month in July and each time had attempted to sell him a watch. "Each of these had a price| tag of $65 to $71 on it," he stat-| ed. 'They offered to cut the price to $35 or $40 but I still was not interested." Mr. Morgan .told' the court that Schwartz had pulled up in front of his home sometime in the middie of July and offered to sell him a "General Elec- tric razor, plus a mecklace for $15." DOORBELL MOTOR He quoted the accused as say- ing: "This is a fine razor. It's General Electric. What more could you expect." Mr. Morgan said he looked at the box in which the razor| was alleged to have been, and seeing that there was no G-E seal returned it without looking) inside. Joseph Kernohan, production Manager for Remingto, Elec- tric Shavers, did not agree with Schwartz' appraisal of the Gen- eral Electric razor. "I tested it. It became un-! bearably hot in 10 minutes. The motor was only the type of vibrator used in a doorbell The cord was inferior. It drew too many amps. "And besides that, it would not shave. It was so poorly constructed that the combs and the cutter don't make contact. | Charles Milne, electrical in- spector for Ontario Hydro, said the razor was a "possible fire and life hazard." "It was never approved by our office and there is no seal to show that it was ever ap- proved by the Canadian Stan- dards Association. "We can lay an information under the Power Commission] Act for the sale of a product that has not been approved. "Any such product we con- sider dangerous." The third expert witness for the Crown was Glen Knapp, a Pickering jeweller and former watchmaker. He testified that all of the jewellery confiscated from the accused was "of in- ferior quality." A bracelet, brooch, necklace- earring set was shown him. with a marked value of $29.95. "It's worth about $4 or $5." WOULDN'T PAY $10 He placed the value of two ladies' watches valued at close to $70 at about $12 to $14. A cutlery set marked $39.95 was introduced. "I wouldn't pay $10 for it The metal and the workman ship are both inferior." One of the exhibits was a set of two Waterman's pens, plus a set of cufflinks, a tie bar and a money. ¢lip. Mr. Knapp valued the jewellery at "about $1.98." : Clyde Gilmour, the area sales manager for Waterman Pen Company, fixed the value of the twe pens in the box at 79 cents each. thei which was stamped with a sim- llated Waterman's k and Fiore Timpano were tryingjhad never been used by his jadded up the estimates of the inferior products.
