Appeal Court Turns Down ~ Tax Rebate Bid LONDON, Ont. (CP)--The On- tario Court of Appeal has dis- missed a test case application by K. A. Edward Construction and the London Home Builders Association involving tax allow- ances on vacant, new houses for sale here of about $15,000 for 1961. The appellants took the test case to county court after a hearing before the court of re- vision. The Appeal Court agreed with the county court judge's decision rejecting the applica- tion. London received about 150 ap- plications from home builders for 1961 tax rebates on new houses which were vacant and unsold. The ruling can affect thou- sands of such homes throughout Ontario. It has been London's policy to allow a 10-per-cent rebate on' rental property that has been vacant. at least three months, | and another five per cent for each additional month the prop- erty is vacant, with 55 per cent the maximum allowance.
