4 THE OSHAWA TIMES, Pridey, June 8, 1962 Zoning Bylaw Hassle Erupts In Township HAMPTON (Staff) -- "Hook up our hydro or we'll sue for damages" was the ultimatum given Darlington township coun- cil yesterday by the Bowman- ville Revolver Club. Bill Kirkton of 239 Montrave avenue, Oshawa, acting as spokesman for the club, said the revolver club and the Bow- manville Rifle Club spent $706 on their building. Councillor Sidney Cornish said that a building permit should never have been issued. Reeve Garnet Rickard sug- gested that the solution to the problem would be the re-zon- ing of the property. "That's impossible," said Mr. Kirkstone. "The owner of the property doesn't want the land Te-zoned." Before the hydro can be hooked up, council must give approval because the club- house is located in an agricul- tural zone. Township Clerk Walter Rundle said people wouldn't get in situations like this if they) hired a lawyer to look into the! building bylaws before they go ahead with their plans. "What you're saying," said Mrs. Mary Rudai, appearing on behalf of the club, "is that a person who plans to build in the township should be com- pelled to hire a lawyer to see if the building inspector was within his rights to issue the permit. In other words even council doesn't trust the build- ing inspector." BLAME SPREAD Councillor Fred Smith charg- ed that the revolver club was just as much to blame as the building inspector. "If you want to have the land re-zoned, then buy the building," he said. "You can't tell us to buy property," said Mr. Kirkton. "And anyway we wouldn't have the funds to do so." "No," said Mr. Smith, "and you can't tell us to change our bylaws." Joseph DeClara, 182 Sammon avenue, Toronto testified in court that on May 13 he was driving south on Harwood ave- nue towards the Bayly street in- tersection.
