Asks Count To Clarify Labor Act Toronto (CP) -- Attorney-Gener- al Porter yesterday invited the On- tario Court of Appeal to clarify for the Ontario legislature the law governing operation of the Ontario Labor Relations Board. He appeared before the five- judge panel hearing an appeal by the Toronto Newspaper Guild against a decision by Mr. Justice G. A. Gale who last June quashed the Guild's certification as bar- gaining agent for circulation de- partment employes of the Globe and Mail. ' Mr, Justice Gale found that the Labor Board had denied the com- pany '"'essential justice" by refus- ing to permit the Globe's lawyer to cross-examine a union witness on the question of resignations. Mr. Porter told the appeal court that when the Labor Relations Act went into force in 1943, it was found that if names of union mem- bers were open to examination by employers, "unfortunate con- sequences' might follow. '"That court (the labor court) de- cided that the names of union members should be kept secret from the respondent (employer) but the practice should be followed that the names should be open to counsel for the respondent.' He said labor boards have wide powers and are masters of their own procedure. The hearing is continuing.
