J. MacRae yesterday allowed an appeal by Fred Zakarow, 639 Ritson Road South, Oshawa, from a careless driving conviction by Magistrate F. S. Ebbs. The fine of $50 was re- voked. However His Honor indi- cated that he was giving Zakarow the benefit of a slim doubt. When the same damage action was tried in civil court last June before jury, a finding of 100% neg- ligence on the part of the appel- lant Zakarow was registered. Yesterday the evidence was taken from the transcript record of the hearing in magistrate's court. A. W, 8, .Greer, K.C, appeared for the appellant while Alex Hall, K.C. spoke for the Crown. Evidence was that on January 9, 1951, late at night, Zakarow was driving northbound up Ritson Road. When he came to the cor- ner of Stacey Avenue, he was in collision with another northbound car driven by Stephen Gonta, 292 Appeal Allowed From Driving Conviction Huron Street, who was attempting to make a left hand turn. Evi- dence by Constable Barker was that Zakarow smelled of liquor. When the constable arrived, he found the appellant slumped over the wheel. He inquired if he was all right and received a reply that he was. However, when Zakarow got out onto the roadway, he "passed out".
