Ottawa, April 26 26 --(CP)-- The; Supreme Court of Canada has set- | tled a controversial point in the] | | nine | number of years in prison. | criminal code in the law dealing | with "habitual criminals." | In a unanimous decision by its justices, the court upheld the Attorney General of British | Columbia in his interpretation of | the law, prescribing the conditions | under which a convicted criminal | becomes a "habitual" and liable to be sentenced for an indeterminate | Te finding of the court grew out | |of opposing views held by the west | coast Attorney-General and the British Columbia Court of Appeal, | involving. four men convicted of trafficking in narcotics, Thz B. C. Appeal Court ruled that thess men, found guilty of similar charges three times previously, were not "habituals" under the court's interpretation of the act. These four men, Gordon Robinson | or Robertson, H. L. McKenna, George Cuthbert and G. A. Beatty, all of British Columbia, now are] liable to be kept in prison for any number of years, with a review of their cases to be made every three years by the Federal Justice Minis- ter, The ticklish question of what was | a "habitual criminal" developed out | po a turn of a ph ase in part 10A of the code. German Army Russ Plan to Counter West Berlin, April 26 --(AP)-- Russia | has completec detailed plans for creating a Communist 'East German army of 25 divisions, an authorita- tive East German source said Sat- urday. He described this army--to be based upon alert units (Bereit- Schaften) of the militarized, 50,000- man People's Police -- as Moscow's ace in the hole if Big Four talks fail to settle east-west differences. Andrei Gromykc, Soviet deputy foreign' minister, denounced west- ern defense plans and hinted for the first time at the possibility of failure of the talks in meetings of the four-power deputies in Paris last week. Allied officials in Berlin confirm- ed several kep points in the report of the East German sources. By this informant's account: The widely reported visit of Georgi M. 'Malenkov of the Soviet Politburo to East Germany in early February concerned military as well as political affairs, Malenkov dis- cussed the army plan with both Soviet officers at Schloss Babels- berg, the residence of Gen. Vassily Chuikov, the Soviet commander-in- chief in Germany, Malenkov told the officers the Politburo had decided to rush the formation of an East German army if the Russians failed to block West German rearmament or to | neutralize Germany through four- power discussions. He outlined this strategy: If the bid to keep Germany as a vacuum fails, East Germany granted the status of a full- flea d satellite, backed by a Rus- sian? security guarantee. After the East German army has been set up, the Russians will with- draw their occupation troops gra- dually and call on the United Sta- tes, Britain and France to follow suit. In preparation for this step, Mal- enkov and the Soviet officers: 1. Prepared the draft of an East German military conscription law. . Directed reorganization East German People's along Soviet Army lines. . Planned re-equipping of this | force with new Soviet weapons. . Ordered a speed-up in the train- ing of .East German pilots and strengthening of the East Ger- man Sea Police, now estimated to number 5,000 men. Allied officials confirmed that large amounts of new Soviet equip- ment are movin; direct from Rus- sian factories to East German de- pots for the police. They said the | equipment includes tanks, artillery and anti-tank and anti-aircraft guns. powe will J of the] Police YOUNG READERS Winnipeg -- (CP) -- The boys' and girls' department accounted for more than one-third of the | Winnipeg public library's total cir- | culation last year, according to | the annual report just issued. | | Will News of Balsam And Mount Zion MRS.
