(258b) Jurist Deplores Lenient Handling Of Old Offenders London--(OP)--A "get tough" campaign against lawlessness, with punishment that strikes fear into the hearts of criminals, is advocated by Lord Oaksey, who presided at the Nuernberg trials of the Nazi war leaders. Addressing the annual meeting here of the Magistrates' Associa- tion, Lord Oaksey deplored the trend towards lenient treatment of habitual offenders and the easing of discipline in prisons. Neither, he said had the deterrent effect of protecting society nor preventing private. vengeance. The only categories of punish- ment at present were imprisonment, corrective training and preventive dentention. Je "Does anyone," he asked, "really believe that these forms of punish- ment are appropriate for those who beat old men and women within an inch of their ilves? Must Strike Fear "To me it appears that some form of imprisonment should be so hard as to strike fear into the hearts of the most hardened criminal." Rather than impose one form of imprisonment, Lord Oaksey sug- gested there should be sufficient grades of punishment to enable a judge to decide what appropriate sentence should be imposed, both in time and quality. It was a mis- take, he submitted, for the prison commissioners to determine what form of punishment a criminal should undergo. Lord Opksey asked why prison officials were protected by forms of corporal and dietary punishment which were not applied in the pro= tection of the public.
