Changes May Be Sought In Auto Insurance Law Suggest Clearer Definition Of Circumstances Under Which - Neglect To Re- new Driver's License Does Not Void Insurance Provincial superintendents of im surance are considering legislation to clarify legal position of an ine sured automobile owner, whose car is involved in accident when driven by a person without a driver's li- cense, The statutory conditions in the standard automobile insurance pol« icy state that among other things, the insured must not use or drive 1, While not quali- fied and authorized by law to drive; or in the case the law does not pre- scribe any qualification or authore ity, while under the age of 16. 2. He shall not "permit, suffer, allow or connive at the use of the automobile . . . by any person not qualified and authorized by law to drive. In some quarters it is felt that under some circumstances the word of these clauses might be un- fair to a policyholder. For example, it has been felt that where a person who is admitted to be a cauable driver neglects to re- new his license and meets with an accident, it would be unfair for an ce company to refuse to pay the claim on that ground. Yet strictly speaking it is held that no matter how well qualified, if his li- cense had lapsed he would not be authorized to drive at the time of the accident, Or a case might arise in which of | &n owner lends his car to someone, believing him to be authorized to drive, when he was not. In such cases the insurance companies as a rule, it is understood, pay the claim and then try to collect from the driver at fault, Some have suggested that the statutory conditions make both qualification and authorization ne- cessary conditions before the pol- icy will be considered valid, Diffi- gully hes been, Jound, however, in g what is meant by " - 1d to drive." "qual has been generally felt, in view of the heavy accident toll, -- nothing should be done to weaken the law requiring all persons oper=- ating cars to be capable, But it is also felt desirable to remove any hardship on owners whose only fault was forgetting to renew thelr license. A report submitted to tae superintendents' association meet~ the following changes: aevesie "The insured shall not use or drive the automobile . . , , unless he is or was at anyttime during the year immediately prior to the date '| of the policy or where the policy has been renewed during the year immediately prior to the date of the last renewal, authorized by law to operate or 'drive an automobile of the type described in the policy, or "While his license to operate or drive an automobile remains sus- pended or cancelled or "While under the age prescribed by law for operating or driving an DAY OR NIGHT phone sold by a widow to a second- band men, t automobile. "The insured shall not. permit, suffer, allow or connive at the use of the automobile "1, By any person who is not for the time being authorized by law to operate or drive an automo- bile or "2. By any person while under the age prescribed by law for oper ating or driving an automobile. By eliminating the word "quali- fled" the suggested amendment as- sumes the holding of a license to be evidence of qualification; while the time limit stated in the clause gives reasonable time for anybody. to re- new his license, The addition of the words "of the type described in the policy" evidently is intended to prevent a person who is qualified to drive say a motorcycle only, from being covered by the policy while driving a car. "Bhe wording "while under the age prescribed by law for operating or driving an automobile" overcomes the difficulty of the present wording "under 16 years of age." Some provinces during the war licensed boys of 15, when it was considered necessary. KATTERBOMB READY-BUILT FLYER Climbs like a Bullet, Flies like a Falcon, Sturdy Construc- 0!
