There were birds of all sizes, col- ors, and designs, some too foolish in appearance to be credible, like the one with a bill tiger than its body; others brooding ove- their plight, like the defiant eagle, whose breast was torn and bleeding. Denver, Colo., Feb. 26--Compan- ionate marriage was condemned in bitter terms by the Colorado State Supreme Court in handing down a decision holding "utterly void" a pre- nuptial contract between the late Dr. Charles M. Duncan. Denver phys- ician, and Hattie E. Duncan, his wife. Chief Justice Greely W. Whitford denounced the contract, under which Dr. Duncan and nis wife agreed to live together ouly so long as both parties were agreeable to the mar- riage, as "nothing more, in effect, than an attempt to legalize prostitu- tion." The agreement provided that if the couple separated. Mrs. Duncan | would receive $100 for every vear they had lived together. and would waive any right to alimony or a wi- dow's share in his estate. ' They were married December 16, 1924, and separated about fourteen months later. Dr. Duncan paid his wife $110 and in turn was given a receipt. After his death she sued for one-half of his estate, which was denied by the County Court. She appealed to the District Court and was awarded the widow"s share. The Supreme Court upheld the Dis- trict Court's finding. "The sacred character of the mar- riage relationship is indissoluble ex- cept as authorized by Iégislative will and by the solemn judgment of a court," the decision declared.
