Then he touched upon the point of quietness that the lad assumed on reaching Oshawa. "If this offence had heen committed against you, would vou have gone back and said nothing about it?" Mr. Swanson asked of His Honor. If the boy complained to the Children's Aid Society then the onus would he on it for not taking action, Mr. Swanson argued. Crown Attorney J. A. McGibhon did not deal with the case in any lengthy address. He believed a clear case was made out by the erown. He pointed out that the evidence of the hoy was unshaken even under the harrage of cross-examination and the crown algo pointed out the fact that the lad had comnlained »f the alleged offence to the matron, medical of- ficer and his friend. In Mr. McGih- bon's opinion the-lad did everything in his power to bring the alleged of- fence hefore the proper authorities, He alluded to the fact that the ar- cused, Mr. Elliott, verified eve vy point in connection = with the tvip with the exception of that part dealing direstly with the alleged offence. Tunch, Mrs. Cath- arine Elliott, wife of the accused, was called by the defence and re- lated incidents in connection with the trip to Lindsay and the stop at Sunderland.
