withhold uncollected taxes Regional solicitor Edward wondered Friday if he were in the same courtroom following stories which appeared last week in two major newspapers He thought hed woo The decision has far- reaching ramifications and could set a precedent in municipal dealings with regional govern ments over taxes said King Township Mayor Margaret Mr said he received calls from municipalities around the country wondering whats going on there following stories in Toronto newspapers York Region initiated action in Divisional Court after King Township remitted only a portion of taxes due in the Sept 30 installment under the regional bylaw While paying interest on the unremitted taxes the township forwarded only those taxes which had been collected from local ratepayers York asked for a writ of mandamus ordering Jubilee grant to buy fountain NEWMARKET Fairy Lake may get a jubilee fountain this summer For years town council has been trying to make a fountain work in the middle of the lake but conditions have always foiled the plans Monday night Mayor Bob said the Ontario government is making special funds available to municipalities from the lottery fund for projects commemorating the Queens jubilee Regional Councillor Ray im mediately moved his administration com mittee to find out if the funds could be used to put in a decent fountain on Fairy Lake Council agreed MAYOR MARGARET the township to pay its tax installments in full or ordered in the regional bylaw The region did not get its writ of mandamus said King Township Mayor Margaret who claims the court did not order the township to pay its taxes The court did declare Wednesday that the township owes its taxes the mayor continued noting the township always accepted the debt Therefore she concludes the court decision allows the township to remit its regional taxes as it receives the money from local ratepayers Tne court told them they have to pay their levy in accordance with the bylaw said Mr Oakes who added there should be no room for misunderstanding The bylaw specifies the date taxes are due and the dollar amount to be paid Both Mr Oakes and Mayor Britnell agree the court composed of three judges did not make a mandatory order A mandatory order is an extraordinary remedy used in extreme situations noted the solicitor Instead the court gave a declaration he continued which declares the rights and obligations of the parties On Sept 26 King passed a resolution or dering its treasurer not to pay the full taxes and instead remit only that portion of taxes which had been collected Both agree the King resolution was quashed which was the regions objective Mr Oakes said But it was only quashed because it was wrongly worded the mayor insisted not because of its intent Trie mayor claims the resolution would have been acceptable if it had directed its treasurer to pay but had limited payment through a dollar amount According to Mayor Britnell the court said the township acted in good faith paying interest on unpaid levies Further she said the court called regional council tyrannical despots Mr disagrees claiming the mayor merely misunderstood one of his jokes The court was ob viously wellprepared for the court case and had read alL material presented mayor Brit said She claimed the township solicitor did not need to say much and said judges questioned Mr Oakes extensively It did not leave the region looking in a very good light commented the mayor One judge said it is unbecoming to see councils squabble and said the money ultimately comes from the same place the taxpayer noted Mr Oakes Further the court wondered why the issue could not have been solved without litigation Judges said the region had not done enough to solve the problem prior to court to require a mandatory order he said The township will study the court decision before commenting on whether it will remit its taxes in full or continue to forward money as it is received from the tax payer
