challenge to its govern ing body York Regional Police Association has charged the regional police with unlawful discrimination senior officers through new policies in rank structure and pro motional examinations A notice of arbitration was served on the police commis sion last week The Era learned The notice was issued by solicitors for the association which represents Yorks rank- andfile The notice claims the com mission illegally demoted all staff sergeants and sergeants to the rank of acting patrol ser geant when it assumed control over Yorks new amalgamated police force this year The de motions result in loss of pay and fringe benefits for the af fected officers the association charges The policemen further al lege that new promotion proce dures force senior officers to write examinations for ranks they previously held when they served Willi one of York Coun 14 local police departments an officer was a sergeant last year before amalgamation should not have to write an examination to achieve that rank again under the regional rank structure the policemen charge They also claim the new motion of trol sergeants with more ex perience If a constable passes Iu examination for sergeant he could outrank a patrol ser geant who either fails or does not choose to lake the test Under the Police Act arbi tration is usually the last resort According to Yorks ice agreement an a grievance would chief Failing succt b1 it then would p direct discussions with the c mission before an arbitrator i called in In this case the If the arbitration procedure is followed through the next step would be to appoint a judge to arbitrate discussions on the associations complaints Should the parties fall to agree on an arbitrator he would be appoint ed by the attorney This is common procedure on forma tion of a regional police force To date no ranks have been confirmed Some policemen partic ularly those who were chiefs or deputychiefs in the county last year were given new acting ranks This action was reclassification by the com mission bat many policemen in terpret the term to mean de classified Under legislation creating the Region of York all policemen must
