expla nation regarding the Newmar ket Committee of Adjustment has been mailed to real estate brokers recently clarifies the aims and jurisdiction of the Committee so that both brokers and their clients will be more conver sant with the powers and limi tations of the group Dears Sirs In tne hope of avoiding con fusion and possible costly de lays in completing real estate transactions we are submit ting the following information which we believe will be help ful to yourself and your staff In general the Committee of Adjustment has jurisdiction in consenting to 1 Minor variances of Zoning Bylaw regulations Division of large lots into 2 building lots Severance of a part of a building lot for the purpose of adding land to another building lot Enlargement of a build ing for purposes other than that designated by zoning but so used before the pass ing of the Zoning Bylaw the most common erroneous assumption is that the Committee will deal with changes in zoning This is not the case For example if an application Is made to change an Zoning to an or to a Commercial or Industrial use this application Is con sidered by the Planning Board which will then make Its re commendation to toe Council The Committee does deal with minor variances to regu lations within the particular zoning For example the Committee may permit vari ances to regulations calling for a minimum frontage minimum lot area minimum front side or rear yard set backs In areas under subdivision control or part lot control the owner of a large lot which could be split into 2 lots may make application to the Com mittee for a hearing Provided the new lots conform with the zoning regulations the sever ance will probably be permit ted The Committee may al low a slight variation in fron tage and area requirements if the two new lots could not be severed In compliance with zoning regulations A divi sion of land into more than two building lots will in most cases call for a plan of sub division and will be dealt with by Planning Board and Coun cil The Planning Act empowers the Committee to impose con ditions to a consent as the Minister of Municipal Affairs may impose conditions in the approval of a plan of subdi vision This means that the Committee has the power to specify the installation of mu nicipal services size and shape of lots grading and fill ing to require road wldenings easements or rightsofway to levy municipal administration fees and in fact impose any conditions which In the opin ion of the Committee Is advis able in a consent Although its powers are very broad Committee decis ions are made with regard to the intent of the Official Plan of the Town of Newmarket and the implementing bylaws Where a real estate transac tion involves a Committee of Adjustment hearing care should be taken to allow suffi cient time when dating options or offers to purchase The ap plications for a hearing re quire certain supporting ma terial and an application may be considered incomplete until this material is received by the secretarytreasurer of the Committee of Adjustment Some time therefore must be allowed for obtaining and pre paring the application From this point up to days should be allowed for a hear ing since the Committee will fix dates for hearing on a firstcome firstserved basis Hearings are public and any interested person may speak on the application Should the Committee decide that insuf ficient information is avail able it may adjourn the hear ing or reserve its decision Copies of all decisions are sent to the Minister of Mu nicipal Affairs to the appli cant and to anyone who filed with the secretarytreasurer a written request for notice of the decision together with a notice of the last day for ap pealing to the Ontario Muni cipal Board A period of days is allow ed for appealing a Committee decision to the Ontario Muni cipal Board If no notice of appeal is received within the 14 days the decision of the Committee Is final and the applicant is notified We would therefore recom mend that at least days be allowed for closing transac tions where a consent re quired It is almost certain that the Newmarket area will exper ience dynamic development in the near future Real estate brokers owners and develop ers will have more contact with Planning Board and the Committee of Adjustment and a working knowledge of the Planning Act
