been In failing health for two months buffered a heart attack A daughter of the late Mr and Mrs Jackson the de ceased was bom at Newmarket on December 23 and was married at Newmarket In July Mr and Mrs Belfry cele brated their wedding anni versary last summer Coming to Oshawa 25 years ago from Sutton when Mr Bel fry retired from the ministry of the United Church of Canada Mrs Belfry was a very hear or consider any objections which Township council or residents were entitled to make concerning the project In default of compliance with that express provision he wrote the department of health hod no authority to approve of the work Moreover and in event the Corporation of the Village of Richmond Hill not proceed with the work unless it first mode appli cation to the Ontario Municipal Board for till order prescrib ing the manner in which the work might be carried on Richmond Hill Deputy Kenneth said council was under the impression it had com plied with all the required regu lations Landing Resident Convicted Of Drunk Driving James Mason of Park Holland Landing was sen tenced to seven days in jail when convicted of drunk driving by Magistrate HotHnrake on Wednesday His car was im pounded for three months and he was prohibited from driving anywhere in Canada for one year The evidence which convicted Mason of drunk driving freed him later of a charge of failing to remain at the scene of an ac cident Magistrate in dismissing the second charge said that in charges laid under the criminal code it was neces sary to prove intent to commit the act This man who as the officer has told us was so drunk that he couldnt understand what was said wouldnt be able to form intent said the magistrate The charges were laid follow ing a collision between the Ma son cor and one driven by Ev erett Hardy of Barrio on the on Dec Mason drove his car from the scene before Hardy could tify him but within minutes of the accident he was arrested at the home of a friend by Con stable Glenn Croulch of East police Evidence was submitted that Mason on three occasions ad mitted to the police that he was the driver of the car In giv ing his testimony Constable Croutch said that Mason was so drunk he did not appear to un derstand the caution which was read to him before statement was taken so that it was read second time He testified that Masons speech was thick and incoherent and that he staggered Defence counsel argued that the time lag between the acci dent and the arrest was suffi cient to warrant dismissal of the drunk driving charge Magis trate disagreed and brought in a
