Lorne Stuart of Grimsby faced Magistrate Campbell in Tuesday‘s county police court on a charge of theft of 314 bags of timothy seed from: Lewis Hawkey, North Grimsby, beâ€" tween January 17 and 28. He was defended by R. H. Yates of Hamilton, declining to elect until later. Hawkey told of having the seed in his cellar on January 17 and missing it on the 28th, with no trace found. On Februâ€" ary 18 he identified two bags in Yewâ€" bank‘s feed store in Cayuga. He said Stuart was in the Hawkey cellar on the 17th. Ernest Hamilton, hired man, corroborated the original possesâ€" sion of the seed and Charles Yewâ€" banks testified to buying seed from accused on January 21 at $5 per busâ€" hel or $33.75 for the four bags. Two days after the bags had come from the Tillsonburg grading station, P.C. Robbie seized them. Mr. Yates, arguâ€" ing for dismissal, claimed bags by hundreds were common and stressed possible conviction on circumstancial evidence, then asked for a remand to April 16, when he would put accused on the stand in his own defense.
