At . the trial of the actions a; St. Cathâ€" arines, Paintiff Zella ‘Thompson was awarded a verdict for $500 for injuries sustained in a colliâ€" sion with one of the defendent‘s trains at Canboro road crossing, June is, last. . W. T. Thompson a verdict for $290 for the loss of a horse and Duggy being driven by <<Zells ‘Thompson. . Defenâ€" dents appealed on the ground that the plaintiff was guilty of contributory negligence in failâ€" ing to look for the train before attempting to cross. The only finding of the Jury on this point was that the plaintiff looked at a distance of 513 feet from â€" the track and the evidence showed that from this point on, there was an unobstructed view of the track. â€" The Divisional Court under these circumstances said the plaintiff should have seen the train coming if she had looked properly, and taken‘ reasonable precaution for her safety, and in their opinion, there was nothâ€" ing in the finding of the jury to indicate that the plaintiff had been reasonably cautious.
