PROTECTING HOMEOWNERS & BUYERS If you're in the market for a new build, you'll appreciate new legislation that will establish a 10-day cooling-off period for buyers of new freehold homes, allowing them to cancel agreements without penalties. It also cracks down on predatory lending schemes that target homeowners. "This is a landmark piece of legislation - the first of its kind in Canada - to protect consumers from fraud and bad actors," Todd McCarthy, Minister of Public and Business Service Delivery, says of The Homeowner Protection Act, 2024. In addition to banning the registration of consumer Notices of Security Inter- est (NOSIs) on land titles, the Act is "giving Ontarians the crucial information and time they need to confidently make one of the biggest financial decisions of their lives" through enhanced protections, McCarthy tells us. Cooling-off Period The Ontario Real Estate Association (OREA) is pleased with the 10-day cooling-off period, a protection already in place for prconstruction condominium sales. "Extending this protection to newly-constructed homes will enhance consumer protection by allowing buyers a 10-day period to review and cancel an agreement without penalty, levelling the playing field between Ontario's hardworking families and well-resourced corporate developers with a team of lawyers," OREA CEO Tim Hudak explains. The Toronto Regional Real Estate Board (TRREB) also gives the cooling-off period its stamp of approval. "It allows buyers to take a step back and get pro- fessional advice on the review of contracts and other aspects of a new home purchase," TRREB President Jennifer Pearce says. TRREB agrees with the government's decision to not apply the cooling-off period to resale homes. The dynamics of resale transactions are "significantly different" from new builds and imposing a cooling-off period could introduce "unnecessary complications and delays," Pearce explains. "While there are merits to cooling-off periods for new freehold homes that could establish protections for consumers against any pressure tactics when purchasing a new build, both sellers and buyers are consumers in the resale market, which is different," she continues. "Most resale home transactions are intertwined and could have a negative domino effect on other transactions in a supply-constrained market." The Act bans the registration of NOSIs for consumer goods on the land registry system and deem NOSIs for consumer goods currently registered on title to be expired. (NOSIs are registrations that may be made on the land registry system by a business when it rents, finances or leases goods such as a water heater or furnace installed on a property.) My husband and I didn't know much about the sport, but became fans since, even at the grassroots level, it's fast and competitive. She continued to play until the pandemic and then did like other kids, finding new interests. This year she tried out for the school team and rediscovered her love for it. We're now back playing house league at the same field as those early days. The girls are a lot bigger now, but the laughs and love of the sport remain. Yet as much fun as it is to watch her race down the field to score, it's the pregame show I like best. Before my big kid plays, the littlest ones are on the field. Watching them run with their friends is so cute. They attempt to scoop the ball with their far-too-big sticks and then stand still trying to figure out what to do next. By the time they decide to run with the ball, they're swarmed by others who wait for a move. Some catch on fast and take off with the ball. I hear the coach calling out "Go the other way...the net is this way!" The player stops, looks around and then heads in the opposite direction with a pack in tow. She arrives at the net, stops in front of the tiny goalie dressed in gear so big she can hardly move. She contemplates her shot while both teams watch. No one attempts to stop her. Parents shout to shoot and she reacts by taking the shot. It goes in and the whole team celebrates. Parents cheer while the coach runs over and gives her a high five. On the sidelines, players waiting their turn by picking dandelions and making bouquets. One child asks about the post-game snacks. Will it be juice boxes or freezies? Last week was blue Freezies. Another peers into the cooler. "It's watermelon." Meanwhile, on the side our big girls warm up, also cheering on the little ones. Most don't remember playing at that age, though they remember the feeling of being part of something fun. A tiny girl in a jersey that reaches her knees runs with the ball. "She's pretty good," says my daughter's friend. My daughter agrees. "Yep...she's not at all afraid." The little girl runs towards the net, trips, and hits the ground hard. She's crying. My daughter and her friend run over, help her up and ask if she's okay. Through her tears, she says she tripped over the dandelions. My daughter asks where she's hurt. "I'm not hurt," says the girl. "I lost my ball." The two older ones laugh. It's happened to them too. With her stick handed back to her, the girl runs onto the field smiling. Soon after, while the big ones play, my daughter's friend trips over the same thicket of dandelions. They joke about how some things don't change.
