DUNSTAN Examiner Staff Reporter Bob Bentley is walking where no one has trod before but he says that doesnt discourage him Bentley former Barrie mayor is trying to unseat Quebec Premier Rene Leves que through class action suit to the Supreme Court of Canada He hopes to gather 10000 signatures from across Canada to support the action Highranking public officials have expressed doubt such suit can succeed Bryce Mackasey former federal cabinet minister has described Bentleys campaign as an ex ercise in futility Sen Carl Goldenberg lawyer and constitutional specialist says there is no pro vision in the British North America Act for removal of provincial premier But Bentley says two lawyers he knows whose hobby is con stitutional law he wont name them or say where they practice have encouraged him to push on precisely because of the lack of establish ed precedent concerning such suit Nobodys used the office like this Levesque before thats why weve got no law says Bentley The uniqueness is the encouragement WHOLE POINT When Bentley says used the office he means misused Misuse of office he says is the whole point of the campaign Bentley says he doesnt object to Levesques preaching of $205000 $1 24000 Special edition reprinted special 1802 Barrie edition of the Saturday Globe has been reprinted by the Simcoe County Historical Association available in time for Christmas The and hopes for the future of its indomitable people This is book to be enjoyed and treasured by resident and visitor alike Written by John Craig and illustrated by Margot Oswald Anderson $1195 Available at Book Stores Municipal Offices and Slmcoo County Museum Bentley and his campaign to unseat Levesgue Trodding where no one separatism and he isnt prepared to call him traitor or accuse him of sedition Ill leave that to the legal minds But Levesque says Bentley is the premier of Canadian province and minister of the Crown to which he was re quired to swear allegiance under the British North America Act before taking of fice And he has no right to use such an office to break up Canada Under the Supreme Court Act the Supreme Court can hear only appeals from lower court decisions or matters referred to it by the federal government Bentley hopes to go the latter route persuading Prime Minister Pierre Trudeau and GovGen Jules Leger through the strength of public support for the campaign to refer his suit to the court Under the act the Supreme Court must hear all matters so referred nce theyve got the qucs tion they cant say this isnt something we can handle says Bentley If federal officials wont go along with him Bentley says he will go to lower court firstwthough he prefers to go directly to the Supreme Court because the issue affects all of Canada IGNORIISUNDER What if the case is heard Levesque is ordered thrown out and he ignores the order havent thought of that one says Bentley would like to think hes responsible enough man in high office to respect the direction of the highest court in this land Even if Levesque was merely warned by the court that his behavior has been improper says Bentley the campaign will have been worthwhile Bentley says the implications of his suit go beyond Levesque as an individual though the campaign is aimed directly on ly at the premier Leves ue has to be the figurehea he says but think there are more dangerous men in the Parti Quebecois than Rene Levesque He singles out culture minister Camille Laurin and Robert Burns minister in charge of the provinces pro posed independence referen dum If Levesque is called to ac count for his actions Bentley says that will automatically set precedent making other Pt ministers accountable as well It would then be up to the federal government to take ad vantage of the precedent ILLlSIRAIIC NEE And if the suit fails altogether Bentley says it will at least illustrate the need for mechanism to make public of ficials answer for improper ac lions Such mechanism could well be included in restruc tured Canadian constitution when the time comes to draft one he says Asked what kind of mechanism he has in mind Bentley says he has no firm proposals but would like to see body such as the Supreme ourt or the House of Commons Bob Bentley pushing for results given the power to sit in judg ment on misbehaving officnals much as the United States Senate can try an American president or other official Christmas Cheer program given boost An armful of groceries and all for good cause Doug IIunnel 10 and Tina Weir 10 both of Barrie display some of the bounty in food and
