his own defence and told Judge An jo the Volkswagen pulled out in to the northbound lane and struck his car WASNT IN HURRY He also said he wasnt in hurry but planned to pass six cars because it was clear enough to do Crown attorney Thomp son urged Judge Anjo to convict Horsley on dangerous driving charge because he admitted that he planned to pass six cars in heava traffic on holiday weeken The minute he started that manoeuvre said Thompson he was guilty of dangerous driving Hermiston asked for an ac quittal saying that the charge of dangerous driving has not been proved beyond rea sonable doubt In granting the acquittal Judge Anjo said that convic tion could be made only if the prosecution proves beyond reasonable doubt that the lives or safety of others were endangered by the actions of the accused He added that the extent of the injuries suffered in an acci dent is not proof of dangerous driving Horsley was convicted on the careless driving charge because Judge Anjo said he felt Horsley did not drive with reasonable consideration for others using the highway The Highway Traffic Act defines careless drivin as operating motor ve icle without due care and attention and reasonable care for the consideration of others using the highway the judge said He decided to suSpend Horsleys licence for three months because the accused had five speeding tickets from February
