in Toronto The fperson who sent in the alarm was never identi ied and probably had no way of knowing that they were opening the curtain on one of Canadas most baffling murder cases Within minutes fire companies were dispatched to Goldberg Bros Monument Works Firefighters burst into the premises and quickly extinguished the flames Firefighter James Ridout was gro ing in the darkness trying to find his way ack to the door when his hand fell on something peculiar He directed the beam of his small flashlight to the object and quickly realized that he had come upon the body of man slumped over desk The upper portion of the body had been terribly burned and the face was charred beyond recognition In this manner James Ridoul found the body of Samuel Goldberg 35 who was part owner in the monument firm An autopsy per formed on Goldberg revealed that bullet had gone completely through his head No weapon of any kind was found at the Crime flashback scene but small tin containing coal oil and large can of motor oil were found on the floor near the desk Goldbergs clothing had been soaked in the oil The police acting swiftly and efficiently guestioned friends and relatives of the eceased Goldbergs wife Sala now Widow with two children Norma and Nathan 21 months could shed no light on the tragedy Goldbergs partners in the monument business were his two brothers Harry and Abe and his uncle Abraham Steinberg Harry and Abe were both absent from the company offices that day and were never suspected of having caused the tragedy MUCH QUESTIONING Abe Steinberg said he had left the company office at pm and was considered by the lice to be the last person to see Sam alive ecause of this the police questioned Stein berg extensively for three hours and finally arrested him on Then on March two days after the murder Det Sgt Arthur Levitt found revolver while sifting through rubbish at the rear of Goldbergs office The 38 calibre Colt had not been tossed away it had been carefully placed under an old cement bag and ushed into the snow bet ween garage an fence The gun contained three empty cartridges and two live shells Within days the police were able to trace the Canadian distributor of the American made weapon The gun had been sold on April 16 1910 to the firm of Wood Vallance and Co in Hamilton They in turn had sold it shortly after but here the trail stopped The gun could be traced no further The city of Toronto and indeed most of Canada was now humming with news of the mysterious murder of the mildmannered respectable businessman Then on March 25 Steinberg had come up with the missing money Since the incident took place the Goldberg brothers said things were never the same and tensions ran high at the monument firm They particularly em phasized the bad feeling between Steinberg and their murdered brother On Oct 1930 Abraham Steinberg stood trial for the murder of his nephew During the trial it was revealed that when Steinbergs house was searched detectives had found overalls stained with human blood Again the bad feeling between the accused and the murder victim was rehashed In sensational move the Crown called one James Creighton who had spent time in the Don Jail with Steinberg Creighton swore that Steinberg told him that he and Goldberg were always arguing He also said Steinberg had told him that on the day of the murder he went to the monument works carrying gun for protec tion During heated argument Steinberg said he had accidently killed Goldberg Then he set the place on fire In Steinbergs defense his wife took the stand and swore that the overalls found in their home did not belong to her husband She said he had never worn nor owned pair of overalls in his life The defense attorney ad mitted to the bad feeling between Steinberg and Goldberg but put forth the rather plausible argument that disagreements bet ween partners was common occurence and did not necessarily lead to murder The defense also murder second time on Feb 1931 This time the defense came up with several wit nesses who testified that Steinberg was in Max Rotenbergs store between and on the night of the killing an could not ve been the murderer Counterin this evidence was that of youthful Max gram who swore he saw Steinberg in the vicimty of thefirebetween630and745 Steinberg was found guilty and was later sentenced to be hanged on April 21 1931 His lawyer appealed and was turned down second appeal to the Supreme Court of Canada was lodged As result of this move stay of execution was granted so that the appeal could be heard The Supreme Court dismissed the appeal and new execution date of July 14 1931 was set Despite petition containing 40000 signatures pleading for Steinbergs life the federal cabinet denied
