restricted area zoning bylaw was not WEATHER FORECAST 18 Pages heard Thursday because the board felt Big Cedar was presenting case for zoning change Miss Corbett ruled that the board would not hear board to approve zoning change without givng the people who live near the companys proper ty chance to comment The board will not direct the passing of bylaw without notice to the people she said There would have to be cir culation If the company does not apply to the township for the rezoning within one month she added the zoning proposal contained in the restricted area zoning bylaw be approved LAWYER OBJECTS Lawyers for the company were presenting planning data related to future rowth of the mobile home su ivision when month township lawyer David White objected saying This appears to be evidence for zoning change Raymond Grav enhurst planning consultant re tained by Big Cedar Parks Ltd to study the companys objec tion to the zoning bylaw told the OMB panel that he believes the bylaw does not conform to the townships official plan He said the townships attempt to restrict the number of mobile homes in the Big Cedar Parks Ltd subdivision violates the townships stated intention in the official plan to honor its committment to permit the companys subdivision The municipality has not restricted the number of units either in the official plan or the zoning bylaw he said Mr Raymond said the OMB should approve without notice to residents living near the companys property zoning change on the property from 081 open space to either Ti mobile home park or agriculture which would permit mobile home development Mr White objected to the ad journment saying he could not see the need for it if Big Cedar Parks Ltd plans to ask the township for zoning change based on new planning and engineering evidence and in tends to notify to all residents within 400 feet of its property Mr White asked the board to note his objection to the ad journment in its record just fail to township York Sand and Gravel Ltd and the owners of land near the gravel pit were revealed Thurs day at the Ontario Municipal Board OMB hearing on the townships restricted area zon ing bylaw and official plan amendment The land use designation on the gravel pit left off the original draft of the townships official plan was the subject of the official plan amendment before the OMB The amend ment was referred to the board because of objections by William and Joan Reid who own property next to the gravel pit The official plan amendment would put an extractive in dustrial designation on the gravel pit and zone 41 acres to the west of the pit as general in dustrial M1 The Ml zoning was the result of an agreement between the township and the owner of the gravel pit Spencer Vernon to let him store uip ment related to his grave pit operationontheland Under the terms of the settle ment the M1 designation would be removed from all but 129 acres of the land and replaced with M2 zoning to permit Mr Vernon to expand his gravel pit operation The rest of the land would revert to agricultural zoning Mr and Mrs Reid have withdrawn their objections to the official plan amendment because of the agreement But another resident James Mallanson objected to both the official plan amendment and the proposed agreement Mr Mallanson who describ ed his decision to object as the biggest decision of my life sai area residents have choice He said the residents will either be stuck with junk yard if the official plan amendment is approved or noisy gravel pit operation if the settlement is approved If the official plan amend ment is ap rovcd Mr Mallan son sai hundreds of thousands of tons of crap would be left on township land Davis encouraged by clinic setup METULLA Israel CP The Israelis call
