West Ward Councillor Joe Bugelli, chairman of the operations committee, said that while the nioney would bring the 30-year.old pool up to standards for this year, a further $63,000 (ap- proximately) would have to be spent to keep it operational after this year. Council, in approviflg the expenditure, also made provision for a study to be done on the pool in t.he fail. Bugelli also told council that -if these funds were spent, it could gîve t.he pool a life span of 10 vears. Pinball bylaw passed Whitby Town 'Council passed its pinball parlor bylaw last Monday night amidst speculation that it would not hold up in court. The bylaw, enacted at the request of the Durham Regional Police, restricts persons under the age of 14 from using a pinball parlor or amusement arcade unless he or she is in the company of a parent or guardian. However, the bylaw was passed after council received a confidential report fromn its solicitor which sources havt said tells councillors that it does not have the authority to enact such a measure. Centre Ward Councillor Barry Evans questioned whether or not council has the legisiative authority to impose the age restriction. "....this council does not have the power to enact this restriction. ," he said. "Evans also said that if the bylaw was passed and then defeated in court, coun- cilqrswoud hvebeen "ac- tii=ireposbl. "If we don't have the power, then what are we doing passing it? " he asked. Evans attempted to have the town solicitor's report made public prior to the vote on the bylaws. However, his fellow councillors defeated his motion on the grounds that any and every com- munication between solicitor and client is con- fidential.
