putes between railway employers and employees to a committee of concili ation mediation and investigation and in the event of such committee being unable to affect an amicable settlement to a board of arbitrators The conciliation committee is to be composed of three members one to be chosen by the company one by the employees and a third by the par ties to the difference The concilia tion committee may act as arbitra tors but in the event of objection be ing taken to this course new repre sentatives on the board of arbitra tors shall be appointed in the same manner as the committee of concilia unfair as have hitherto been exercised by the Railway Committee of the Privy Council Discussing this feature of the mea sure Hon Mr Blair said provision had been made to strengthen the hands of the Commission with larger powers than is given by any other countries having commissions so as to enable them to exercise a salutary and restraining influence by its ex ecutive authority Referring to the number of mem bers to compose the commission court the Minister of Railways said that personally he had a preference for three but proposed leaving that point for future determination three or five In regard to the tenure of office the bill proposes ten years members being eligible for reap pointment An age limit beyond which a commissioner couM not hold office is also fixed The bill how ever- also provides that for cause any member of the Commission may be re moved by the GovernorGeneral in Council Mr Blair next explained that the Bill provides that a majority of the board has power to decide any ques tion within its purview and ono member may act provided that the matter with which he is dealing is not contentious For the present the question of salary Is left in abeyance With the undesirable results arising from the operations of a commission in the United States Hon Mr Blair proposes in this hill to make the commission the absolute judge of law and facts subject to the Gov ernor in Council except as to Ques tions which it is of course impossi ble to limit or restrict in any way subject to the submission of a case to the Supreme Court With regard to the rates and tolls the bill makes ample provision against undue preferences Clauses are introduced relating to the long and short haul and shippers and those who use railways are adequate ly protected in the enjoyment of their rights so that all persons shall have equal privileges Questions of thru traffic uniformity of rates and class ification and also from foreign countries are all dealt with and ihe clauses relating thereto have been drawn up after consultation with men of long on both sides of the conflicting interests involved Government railways are not subject to the control of the Commission Referring to the classification of freight Hon Mr Blair explained that the freight tariff would be divid ed into three sections viz special and competitive The sched ule of tarifi as the law stands at present emanates the Railway Committee and appro by the Gov ernor in Council hut after all It is only a maximum tariff In practice it Is always in excess of the tariff actually charged This will be changed under a Commission The companies may propose their tariff but the board may say We will not approve of such a tarifl Further more the bill gives power to the Board to prescribe what the tarilt with railway matters another with technical railway knowledge and a third representative of the farming and other commercial Interests of the country The bill does not deal wit railway strikes that interest being dealt with by the measure pro posed by the PostmasterGeneral The foregoing embraces the main features of the measure proposed by the Minister of Railways as glean ed from his reported
