com munity could be developed Opposition raised at NEC hearing on proposed amendment A decision on a preliminary motion introduced Monday by Walker Brothers Limited an op ponent of Niagara Escarpment Commission Amendment 52 ban ning waste disposal sites on the escarpment will be announced today Wednesday The NEC put its support behind Amendment in July The amendment requires applicants waiting to establish a waste disposal site on the escarpment to first obtain an amendment to the Niagara Escarpment Plan Cur rently an amendment isnt always required NEC senior Planner Marion said Tuesday the lawyer for the Niagara Falls based waste management firm Walkers Brothers Limited introduced a preliminary motion saying the hearing should be stopped because the Hearing Officer doesnt have to rule on Amendment The lawyer the com mission changed the content of Amendment 52 between the time the commission initiated the amendment in March and the time the NEC came out in support of it that summer said Ms The commission failed to seek input by outside agencies once it supported the content changes and therefore the Walker Brothers lawyer said the hearing officer would only have jurisdic tion to rule on the amendment once the new version of the amendment had been circulated to the necessary agencies she ex plained But the commissions stance is that the hearing officer does have jurisdiction to make a ruling Ms Plaunt explained the com mission believes the new version of the amendment only came about after agencies had submit ted comment on the amend ments content In response to the valid concerns the amendment was improved she said Since the amendment was cir culated once and now better reflects the concerns raised by the commenting agencies there is no point in circulating the new
