under a twoyear sentence imposed bv magis trate f s ebbs pleaded guil ty to a breakin and entry charge car theft and escaping custody all offences committed more than two years ago he was sentenced to two years on each charge al to run concur rently he will serve this two years when he finishes a two- year sentence handed down in uxbridge in 1952 by magistrate ebbs on a car theft charge this sentence was never serv ed because marchuk escaped from the ontario county gaol on the next day at the time of his escape october 3rd 1952 marchuk was remanded to this jail to await trial on a charge of brea king and entering the uxbridge creamery on sept 12th of that year yesterday in whit- by he pleaded guilty to the charge constable swinson of uxbridge told the court that on that night he had approach ed the creamery on patrol and heard a hammering noise he called constable wilton of the uxbridge detachment of the opp and later that night the car which constable swinson had seen parked outside the creamery was found in a ditch nbout four miles south of the town marchuk was approach ed later on foot near stouft vilie jail governor james suther land on the escaping custody charge told the court that about 3 am october 3rd 1952 he had been awakened at the jail a search was made of the second floor he said and later outside while searching out side a car sped away from the countyowned garage an inspection of the cell which marchuk had occupied and had absented himself from said mr sutherland showed an eightinch by 14inch hole in the brick ceiling in the at tic above he said a board had been ripped off the roof and a rope of torn blankets led from the roof to the ground allan lavds courthouse caretaker told the court that his car had disappeared that night and was found in york county later with a dead battery and igni tion wires crossed george boychyn acting crown attorney read mar- chuks record which began in 1927 in juvenile court since then marchuk had acquired something of a record by hav ing 27 convictions against his name he has been in peniten tiary five times since then and served 15 years following his escape from here 2 years ago he was
