euphenia on friday sept 23rd while holidaying there with her husband in her 48th year before her marriage she was mary louise carter only daughter of the late mr and mrs john carter who spent a number of years in whitevale district and later at scugog island her mother died when she was a young child and most of her life was spent in toronto with annual visits to whitevale green river and scugog island where on account of her friendly jovial manner she made many friends she is sur vived by her husband and one son ross taylor who live in tor onto funeral services were con ducted at giffen mack introduced in evidence in court last week by complainant dr g w armstrong toronto parliament street physic ian who has a summer home close to edwards hearing of the com plaint that the excess barking of the canines was a nuisance and contrary to pickering township bylaw no 1750 consumed three hours and 12 witnesses were heard due to the conflicting evidence of the prosecution witnesses with that of eight defence witnesses who said they heard lots of dogs but not these particular dogs judgment was reserved for two weeks the hearing found pickering chief of police john irvine in the roles of prosecutor for the town ship witness for the defence investigator and court constable pickering councillor clare bals- don said that council appointed him a committee of one to go to fairport beach and investigate the complaint of dr armstrong he did visit the beach one sunday evening and spoke to the neighbor who had no particular objection to the dogs magistrate ebbs pointed out to the witness that he had based his report to council on this cursory investigation while a petition with 34 names was being prepared by way of objection i didnt know at the time there was going to be anything like this replied the councillor mr edwards identified himself as manager of the great lakes steel corporation of canada neighbor william freymouth when questioned closely about the times at which the dogs bark said they dont stick to any schedule they howl whenever they want to express their feelings i live 1000 feet away but they often wake me up and bother me my wife used to pass edwards to get the mail but the clogs would jump up on her so she had to stop i wouldnt go past the place without carrying a stick pickering township council is being petitioned by about 30 resi dents for the the court the charge alleged that the nuisance was in full force on or about august 14 but evidence was that it had per sisted every day this year mrs armstrong testified that she and her son have both been seriously ill rest was prescribed and rest was what she expected to obtain at the beach resort i am fond of dogs said mrs armstrong but these are only about co feet away when they all start barking at once the noise is terrific magistrate ebbs isnt it a little unusual for a man to keep nine dogs dr armstrong it certainly is dr armstrong went on to read a letter from his real estate broker who stated that his summer pro perty had been listed with them for sale but that they found it was greatly devaluated owing to the presence of a kennel and the terrific commotion noted by the prospective clients the result was that no sale was effected several witnesses for the prose cution vwhen asked whether or not they complained to edwards said that they did not wish to lay a charge against a neighbor and felt it would be no use speaking to him about the matter as he wouldnt pay any attention neighbors living at distances up to 1000 feet away testified that they were constantly awakened and annoyed by the dogs defense counsel r g h alex andor called eight witnesses first was to identify a professional engineers sketch of the properties surrounding the edwards resid ence then mr edwards was put on the witness stand he said that he breeds dogs as a hobby and has ten at present they are used for show purposes he denied that they bark during the daytime dr armstrong said mr edwards several times hollered over the back fence by way of complaint and that he was abusive to his housekeeper my dogs are the best behaved dogs youve ever seen said mr edwards finally a report of constable fred white was read he spent an hour and five minutes at the arm strong home on sunday night but heard no barking one lady took a petition to dr armstrong calling for a subway at the fairport beach crossing where milton woods was killed recently dr armstrong told her she said that he would sign her petition if she would sign his call ing for revocation rt pimnis kennel license doherty jim coates and- wm reesor the deputation with g m forsyth as spokesman contended that the township should not have purchased twelve acres of land for the new school at 1000 per acre when they required only seven to ten acres for the building council pointed out that the involved that it appears on the surface possibly it will have to be dealt with in another way whether it is wise to allow kennels so close to residences citizens have their rights additional land would be required for future expansion and if build ings were allowed to be erected close by the school the cost of
