of a court action would arise in case a tractor and a licensed motor vehicle met in a collision last week such a case came before the assizes at walkerton and proved most interesting it took the greater- part of two days to hear the action was brought by harvey j bryant of hamilton and william r vallins of owen sound for damages that they sustained on the 30th of august 1917 when in travelling north on the lucknow- holyrood highway they ran into the rear of a selfpropelled com bine owned by william eadie a farmer of the holyrood district and which was driven at the time by mr eadies son lome eadie the first problem that presented itself was as to whether the com bine was a motor vehicle or a vehicle under the meaning of the highway traffic act or whether it was simply a farm machine upon this question depended the deter mination as to what particular lights if any it should carry it also effected the question as to whether or not a combine required a license when travelling upon the highway or not if the machine was found not to be a motor vehicle then the owner of the same would not be liable for the negligence of its driver as in the case of an ordinary automobile but would only be liable if the person driving it were his partner in business or were an employee driving the same in the course of his employment and on business of the owner an action for damages arising out of a collision caused by a motor vehicle on the highway has to be commenced within a year of the accident whereas if this were not a motor vehicle the restricted time would not apply and the son lome eadie who had been added as a defendant after the year would automatically be released from any liability whether he was to blame for the accident or not another point which took a great deal of the time was in the determination as to whether at the time of the accident it was after dusk or not because the statutary obligation to carry lights on any vehicles arises only
