anniversary services held in the united church here last sunday the claremont and north pick ering branch of the red cross will imake a salvage collection again this fall and all are asked to put aside their material and have it ready for the collectois when the date is announced decoration service this sunday the annual decoration and mem- erial service will be held in the union cemetery here given in marriage by her grandfather mr a d peters of port perry looked charming in a floorlength gown of white sheer and lace over taffeta her finger tip veil of tulle was held in place with a brougham crownattorney a f annis extends welcome to judge german norman carlton of the 5th con cession pickering township was convicted en a breaking and enter ing charge when he appeared be fore judge j c m german of cobourg in the county judges court at whitby on monday he was given 15 months at burwash in dustrial farm the charge against carlton arose out of the theft of a crate and a six- quart basket of eggs and a jar of pickles from the home of wjl middleton of broughnm on the night of april 6 accused denied the charge but no defense was offered in his behalf defense counsel rd ruddy of whitby claiming the crown hadnt made out a case against accused according to the evidence of constable john norton of clare mont tire tracks similar to those found at the middleton home when the theft occurred were made by a car driven by accused and the eggs were found at a nearby farm while his car was still there following this investigation of ficer norton testified middleton suggested that they so to the carl ton home they went there and to a farm owned by a man named clarke one of oarltons friends but saw no sign of the accused as they were proceeding they came to a ranch owned by dr mcewen and worked by ben vanluven at the lime here they noticed carltons car which middleton recognized since carlton had worked for him only a few days befaore leaving the officers car at the highway they proceeded up the drive as the car owned by carlton pulled away and approached the main road the constable stopped it found carlton at the wheel questioned him and when he denied any know ledge of the theft suggested they go back and question vanlaven find esc and accud together middleton aad carlton went into the house to speak with the farm er norton testified and he stayed outside and followed the tracks of the carlton car- around the house where they stopped he claimed he found the stolen articles with the crate covered by a potato sack af ter that he stated he placed carl ton under arrest ben vanluven who operated the ranch for dr mcewen told the court that about four days before the breakin he started to board at the carlton home and shared a room with the accused for three nights he recalled young carlton slept with him but on the night in question he was not around when vanluven himself went to bed up on waking in the morning however he found carlton in bed and he remained there after the ether got up and went over to the ranch about a mile away while he was here he stated carlton drove up he got out said something about the weather and went off some where he saw him take nothing from the car he said shortly after wards he said the officer and middleton arrived asks case be dimixsed following the luncheon recess mr ruddy moved that the case be dismissed an the grounds that the crown had not proved its case he outlined where the crown in his estimation had not proved beyond a reasonable doubt certain pertin ent facts a great deal had been said mr ruddy pointed out about the tire marks the constable could talk of a particular type with au thority he admitted since he dealt with tires at his garage but at the same time he pointed out the officer hadnt made any observations about any footprints perhaps he wasnt a shoe sales man commented his honour complimenting mr ruddy on the manner in which he had presented his case judge geiman said he couldnt help but find that noiton was telling the truth i was very much impressed with his nortons evidence he re- marked he said that he noted that vanluven seemed to give his evidence for the crown lather re luctantly and because of this fact he placed moie credence in what was said accused a conundrum crown attorney allin annis said that carlton was one of the con undrums of ontario county he pointed out that he had had three previous convictions and like this case all were for quite unexplain- able and foolish acts he felt the community was better off without j him j at the request of the judge the father of the accused was called forward and asked a number of small arms i l uiivtci small arms such as the famous bren light machine gun produc ed in quantity in canadian plants make the mr arlton pointed out that his acquainted for many years and thought that middleton was res ponsible for leading him astray it had been brought out in cross- examination that middleton had a police record as well as carlton he stated that middleton had frequent ly been with him when they had drinks and that this kind of pas- son and middleton had been socially time had nofbeen good for his son
