judge criticises uxbridge assessment continued from page one nounced tlie hearing lasted two days with judgment heing handed down last week the appeal had previously been taken hefore the court of re vision and a reduction made but it was still contended by the appellants that the assessment was out of line and the matter was taken to the county judge the property of the uxbridge farmers cooperative company limited is of frame construction and was recently renovated and partially ebuilt an assessment of 3700 on building and 300 oii property was returned on the roll by w vesey assessor business assessment was set at 1500 taken before the court of re vision the building valuation was re duced to 3000 while the land was dropped to 200 the business asses sment was left untouched in upholding the valuation as set by the court of revision judge coleman stressed that he did so only on a point of law as there is no pro- aison made for equity in the assessment act the assessment act section 39 libsection 1 provides that land shall be assessed at its actual value the judge pointed out therefore it is the duty of the assessor of every municipality to assess land at its ictual value however he remark ed there were unfortunately many municipalities where that provision of the assessment act is not ob served judge coleman stressed that his decision was bound by the law as stated in the act and while there is provision in the division court act which allows a judge to decide cer tain cases by equity and good con science tliero is no such provison in tlie assessment act several other valuations of pro perty in the- town were placed before tlie court including that of a home owned by eva almeda vesey wife of the assessor which was valued at 350 it was also shown that several mills factories and store properties wero not assessed in proportion to the valuation of the cooperative premises as to allegations of fraud which were raised i say allegations al though there were no specific allega tions but innuendos on the evi- denco adduced before me i could and nothing to indicate that there was any fraud of any kind in con nection with the assessment ho said i feel vory strongly about this appeeal however a comparison of values of other buildings to their assessed values reveals a most mark ed and astonishing nnder-aoscss- ment judge coleman stated whereas this building was assessed at approximately one hundred per cent of its value i find that other mills and factories and store prem ises in jhis corporation in many cases are assessed at fifty per cent and lower tho evidence was overwhelming ly that there was on the whole a most drastic underassessment it would not appear that the assess or had followed any of tho principles which he should have been following the act distinctly says what he shall do and sets forth his duties i am not sure that so far as the asses sor is concerned that he is qualified at all for the position i suggested to this municipality that the whole assessment scheme be overhauled and the assessment brought up to its actual value judge coleman declared the joy of yuletide season at this happy time of the year we join
