this point he said he needed twentyfive dollars for a summ ons and that if he didnt get it it was going through here pointing his finger at his tem ple miss madill stated that she saw 0ghs back as he went out the door after bennett when bennett started for the till ough started for the door she related she said that she had not seen her cousin for some three years previous- mrs madill had not seen ough as she was lying down in the room at the back but coirobor- ated the rest of her daughters testimony she stated that after bennett had left olive came out to her and said jacks been in and emptied the till again oliver madill said that he had been workng at the rear of the premises and heard voices but thought it was just some cust omers in the store bennett was called to the stand by duncan b mclntyre whit by counsel for ough and told court that on the two occasions that o had driven him out to altona- he had told his friend that he was going to borrow money from his relatives he and said he had paid this back and had paid ough six dollars on the occasion of the first trip to altona when he stole the ten dollars he had paid most of the balance since he said but persisted that ough knew noth ing of the crimes he stated that he had been intoxicated on june 2nd when he went out for the last time but that ough had not known what was going on he ough and 0ghs girl friend were in the car- he al leged and after ough followed him to the store he told his friend to go back and wait in the car as he wanted to talk to his uncle he said ough admitted driving ben nett out to altona on may 29th and june 2nd but said he knew nothing of the proceedings and did not know that the money subsequently paid back to him by bennett had been stolen though he admitted receiving 55 from his friend- sergeant a lee of the tor onto police force told the court that he had arrested the two men in toronto and found ben nett with tape over his eyes and wearing a pair of dark glasses ough had also had a pair on his person the only particle of evidence that in any way suggests that the acc knew anything of this offence is that of the first witness observed defense coun sel mclntyre who stated that the evidence was as much con sistent as it was with guilt the most important evidence before the court is that of olive madill stated his worship oy the only contradictory evidence is
