second afternoon of the browndavis trial from glasgow continued in the music hall at uxbridge on thursday arthur greer new counsel en gaged by davis said he was content to have all character evidence against mrs brown stricken from the records but maintained his right to produce evidence in support of walter davis character which he held was at stake magistrate ebbs agreed several witnesses testified during the afternoon to the high standing in which davis is held in the community where he resides at one point the crown observed that davis was being so exalted that itii would be running for meiriber of parliament the case continued from 230 until five oclock and adjourned again for one week considerable time was taken up in proving that davis was a legally appointed ipjouhd keeper loraine hisey the last witness in the box on november 25 was recall ed and again told her story how she stood in front of ralph davis hoiise- and saw walter- davis the accused enter mrs brawns premises aci053 the road hand in a white paper mu start back toward the road mrs brown called him when he had reached a point near the barn going toward the highway he stopped and she went down to him couldnt hear the conversation but she heard mrs brown swear at him she rushed at him the witness said and hit him a swat across the face he shoved her and she half sat and half laid down she was sure she was in a position to see everything and didnt see any kicking done by mr davis mrs brown got up pick ed up a board but did not hit nim with it dr darling was also recalled he has been a medical practitioner in goodwood for 42 years mrs brown he said came to him the day after the fracas showed some bruises on the outpart of her right leg they look ed like old bruises in the final stage of healing it was impossible that they could have been made the lay of the trouble when ho interceded several days later to induce mrs brown not to get into court aha said you have sold out to davis- william eckardt garageman in uxbridge visited the scene of the trouble and stood on a spot at or near where loraine hisey had witnessed the affair he could 3ee children playing in the brown yard 350 feet off had known davis 35 years and knew him to be well thought of in the section it was when giving this character evidence that the crown prosecutor annis of oshawa objected and mr greer ask ed that mrs browns record be struck from the evidence eckardt had many dealings with davis and found him upright the tax collector distln mcdonald called- to the box said he had known davis all his life his general repu tation ho said was beyond re proach he had looked over the place where the trouble occured and could see plainly into the brown- yard hezokiah roac township clerk said ho had looked up the records and found davis legally appointed pound keeper mrs brown he said came to his home in goodwood the day after the row and consulted him about the charges made for her cattle being in pound he figured them up and found the amount charged a few cents over his own estimate here a long argument en sued about tho davis appointment whon magistrate ebbs observed that it was a singular thing that mrs browns cattle should have to be the first ever in davis pound mr roach said he didnt think there was any thing wrong aliout hers being the first mr roach also gave davu a good reputation as did mrs roach who said she saw mrs brown at the roach home the day after the trouble no props under her then observed mr greer none said the witness dudley white chool trustee with davis said he saw davis four or five days after tho row there was a scratch on his face he had visited the scene and estimated the distance between davis witness es ard where mrs brown and davis were standing at 320 feet he tod of a previous visit to mrs brown home over school matters during the talk which ensued about the conduct of mrs browns boy at school she ruhed at davis acrrss the room of her home grabbed him by the collar and called him a d liar this evidence was objected to by mr annis said mr greer i want to bring out that she attacked him on this occasion i want to show animosity- this woman is a dramatist and this mans reputation is at stake over this tempest in a teapot mr greer contended it was new evideme which he had a right to use the crown wondered why mr davis hadnt told of this incident when he was in the box the iprevious week his worship said go ahead maki it brief and then the incident was related a lot of argument took place when the crown tried to get mr white to relate the exact conversa tion which led up to the accusation made by mrs brown george brown employee of walter dsvis was sent to mrs brown last sept on instruction of walter davis school trustee to de liver a paper he asked her to sign it she refused and said why didnt davis come himself and that she was waiting for him and ill get him yet brown swore what did you do then i got on pretty quick waiter burkholder testified about seeing mts brown on november 1 1 walking toward- stouffviue going fcmaruy robnewas holding her up she showed ko distress he knew the accused 10 years and he had au excellent reputation to a question put by the magis trate as to why 3idnt davis send his man friday to serve the second notice mr greer answered he had to deliver that notice in person as his duty as pound keeper ralph davis brother of walter said he had warned mrs brown three times aibouther cattle being at large and getting into his premis es hers were the only stray cattle ever on his place he was followed by fred middleton who testified to the good character of the accused this ended the evidence for the de fence provincial officer clark was called first for the crown he had visited the scene and measured the dis tance between where brown and davis had the trouble and where davis witnesses were said to b standing across the road it was 420 feet by the line of vision there was no obstruction but one couldnt see the details he said mr greer do you mean to sug gest that lornaine hisey couldnt see what went on constable i am not suggesting that the constables evidence wa- brief and the crown decided not lo place mrs brown in the witness stand again im sorry my friend denies me the opportunity to exam ine his client said mr greer warning of another case the evidence all being in it was announced that court would adjourn for one week when the contending lawyers would be heard to conclude the case just before adjournment mr greer asked for instruction from his worship my client does nt wish to be vindictive but he is prepared to lay a charge agains- mrs brown now thats a matter between you and your client said his worship who also added that he could see no reason why it could not stand untp next week mr greer said he would prefer a charge against mrs brown under section 168 of the criminal code for wilful obstruction of any person in the performaree of iieii taken to the heise hill church assembled on sunday afternoon out of respect for the late d w heise who died at his home in gormley on thursday afternoon in his 78th year his death was not altogether a surprise to the intimate friends for his health was ebbing fast and he realized himself like his lord and master when his time had come that his earthly toil was at an end and he awaited with keen expectancy and in simple t aith for the great summons home sundays service was carried out as it were under orders from the very hand of mr heise the hymns sung were of his choosing and he requested that there be no flowers but in his graciousness stipulated that should any come they were to be received the brethren in christ church does not encourage money being needless ly used in this manner however one wreath from the bethesda stouff viue telephone co was on the casket bishop e j swalm preached the sermon and explained that this and other detail had been recorded by the deceased the bishop was in a small california town a week prior to the death of mr heise but by some strange urge he just rushed home he had said once that he would go across a continent to carry out the request of his friend that he preach his funeral service he did for on stepping off the train in toronto he was advised that d w heise had passed on only a few hours the text chosen toy the bishop was job 161819 and these words my witness is in heaven and my record is on high the speaker said he regarded mr heise as a father he had done so much for him in the church he ex erted a great influence especially in its committees and on the staff of general conference where ho was honored with a place eight times he was a memlber of the foreign mission board over twenty years others paid tribute to his life and preaching ability summing them up it might- fairly ibe said that his words had power because they accorded with his thoughts and his thoughts had reality and depth ne- cause they harmonized with the life he had lived it was not mere breath that this preacher uttered they were the words of life because a life of good deeds and holy love was melted into them bishop alvin winger one most dear to them live skunks and skunk hides presenting what was purported to be a game wardens badge two unknown men succeeded in inducing bob overs of ballantrae to hand over a foundle of skunk court hear ing bob so constable windsor re ports became suspicious and while handing over to the trlekers ho took the number of their car license the plates were later found to have been stolen from
