has to say in defence of increased tax to separate schools mr irobuck makes the governments stands most clear and fair the ontario government will try an experiment in slum clearance by building two houses in each of tor ontos seven suburban districts at a cost of 2500 and 3000 each housing schemes have been talked of for many years but this is the first experiment by the hepburn government and if successful will undoubtedly lead to an extensive building program in various parts of ontario the provinces of quebec and manitoba will each have a provin cial general election this summer the former will be held in august and the latter in july the major factor in the quebec contest is the laction liberate nationale party under the leadership of mr paul gouin with a program of radical given free standard coach honest says hon mrroebuck it is essential that we keep in mind what the school tax amend ment of 1936 is and what it actu ally did lest we be taken for a ride into the field of what it is not and what it did not do hon arthur roebuck attorneygeneral of on tario told huron south liberal association last week once lose your grasp of the actual reality and one may find himself tilting against windmills of fancy or pursued by spectres of the imagination mr roebuck said our conservative friends have a factory in which fearful fiends of the kind are manufactured declaring that the conservative policy was to subsidize needy sep arate schools out of funds raised by general taxation the bulk of which was paid by protestants mr roe- buck asked would it not be fair er for all concerned to allow the sep arate school sections to raise their own taxes from their own people in their own localities irrespective of whether the property is in private or company control the school act of 1936 did one thins only the property of certain corporations to the extent owned by separate school supporters was made subject to taxation for separ ate school purposes that portion of corporation property which is own ed by public school supporters re mains as formerly subject to taxa tion for public school purposes of course there are a number of sec tions in the act but they are mere details setting up the machinery by which the idea which i have stated in one sentence is to be carried out it has been the law as far back as 1s86 that shareholders might notify their directors that they were separate school supporters and the directors if they wished might re quire the municipalities in which- the companys property is located to divide its assessment between sep arate and public schools in propor tion as the shares are held by sep arate school supporters giving notice so that the principle of such a division is not at all new but it has been found that boards of directors have ibeen reluctant to take actio for many reasons one of which is that separate school rates are usually higher than public school rates former law ineffective and so the former law giving separate schools taxes of corporate property in proportion as it is owned by separate school support ers proved ineffective previously the municipal authorities were compelled to apportion the assess ment on receiving notice from the directors now the directors are re quired to take action on receiving notice from the shareholders then there is a further detail arising out of the complications of modern company organization be cause of the large number of shares issued and the wide distribution in point of residence of the sharehold ers it is impossible to determine in some cases the proportion of shares held by the two classes of school supporters but it may reasonably be assumed that the division of cor porate property in any municipal ity will be approximately as the protestant and roman catholic pub lic or common school supporters and to give to he support of the sepa rate schools the property of roman catholics only who are separate school supporters what then is the conservative policy we know the conservative policy because they have been recently in ollice and we know what they did and further we have some indication in what their leader is saying but beforo discussing where the policies of the parties differ let us note where they run parallel in the first place be it noted that neither party proposes the aboli tion of separate schools and neither of 1sc7 cities corporations growth when george brown for the liberals joined sir john a mac- donald for the conservatives to bring about confederation it was on the basis that there should be separate schools and that separate school supporters as the name im plies should pay their taxes to separate schools and public school supporters should pay their taxes to public schools the separate school supporter was required to give notice that he desired to be so as sessed and in the short act of 2s sections no machinery was set up for the division of company prop erty the reason for the omission is that the subject is complicated and the amount of property held by corporations was at that time un important it was trivial then but everyone knows what has happened in the last 70 years with the evolution of business a large part of the nations wealth has passed into corporate control in con sequence the per capita revenue of the separate schools has declined as compared with that of the pudlic schools the matter became of import ance as far back as 1ss6 when the legislature of ontario provided for the division of company taxes on the basis of the ownership of shares leaving the initiative in making the dvision in the hands of the board of directors this was unfortunate for while the act of 1886 settled the principle of the division of cor porate property in proportion to the ownership of the shares it did not solve the practical difficulties of the division directors did not take action and financial con ditions in the separate schools be came progressively worse by the time hon george s henry became prime minister and minister of education the need of the separate schools had become so great that something had to be done mr henry himself stated in the legislature at the last session that unless action had been taken some of the schools would have closed for want of funds the con servative government of that day adopted a policy with respect to separate schools and wrote it into the statutes of ontario that policy was in marked contrast to the liberal policy as written into the statutes of 1930 acknowledged need in its act of 1930 the conser vative party acknowledged the privilege of separate schools their right to financial support and recog nized the need for additional money made necessary in part at least by the inequality in the division af company assessment in these mat ters there is no clash between the parties it is in the practical mea sure adopted to provide the addi tional support and to meet the need of the separate schools that you will find the clash this is the issuo which divides the parties today the act of 1863 provided that legislative grants to schools should be divided between the public and separate common schools on the basis of average school attendance the conservative act of 1930 set aside the priuciple of equality of division in accordance with school population and substituted a divi sion at the unrevised discretion of the minister of education this is the clause in the department of education act of 1930 in question subject to the regulations to apportion all sums of money appropriated tor public and separate schools among the several cities towns and vil lages and among the rural schools having regard to the attendance at the schools the value of the property liable to taxation for school purposes the expenditure of the board upon education and to such other considerations as in the opinion of the minister should affect such apportionment it is to be noted that regard is to bo had to basic school law was enacted in 1863 and confirmed in the british north america act i elated with such other unnamed con siderations as found favor in the opinion of the mnster in that enactment all principlo in the division of money between public and separate schools was abolished and the minister was given carte blanche to do as he liked club nnd bait subsequent events have re vealed the true rharacter of the un named considerations tho act was passed with the cowardly intention of doing in secret for the separate schools what the government was afraid to do openly and of keeping in the
